<br />A RESOLUTION DECLARING IT NECESSARY TO REPAIIt SIDEWALKS AT
<br />THE FOLLOWING RESIDENTIAL PROPERTIES LOCATED IN THE CITY
<br />OF NORTH OLMSTED: CHARLES ROAD (NOS. 6507, 6523, 6603, 6635, 6652,
<br />6684, 6700, 6715, 674'n AND GEORGETTE AVENUE (NOS. 4404, 4626), AND
<br />DECLARING AN EMERGENCY
<br />WHEREAS, this Council has been advised by the Administration that sidewalks located at the
<br />following residential properties: Charles Road (Nos. 6507, 6523, 6603, 6635, 6652, 6684, 6700, 6715,
<br />6747) and Georgette Avenue ( Nos. 4404, 4626) are in a state of disrepair and constitute a safety hazard to
<br />pedestrians; and
<br />WHEREAS, Section 1363.07 of the Real Property Maintenance Code requires, among other
<br />things, that residential property owners keep their sidewalks in repair, and repair or replace sidewalks with
<br />a grade separation greater than one inch, or where surfaces are eroded or pitted to such an extent as to cause
<br />a safety hazard to pedestrians; and
<br />WHEREAS, the owners of the above-referenced residential properties, even though each has
<br />been sent written notice by the Engineering Department during the period August 9, 1999 through October
<br />1, 1999, that they are in violation of the said provision of Section 1363.07 and must immediately effect
<br />repairs to their sidewalks, have failed to effect the necessary repairs to their sidewalks; and
<br />WHEREAS, pursuant to Section 729.01 et seq. of the Ohio Revised Code, the City of North
<br />Olmsted is empowered to authorize repairs to said sidewalks and assess the total cost thereof against the
<br />lots or lands abutting thereon; and
<br />WHEREAS, it is the desire of this Council that the City, in order to eliminate the existing
<br />pedestrian safety hazards at the above-referenced properties, effect the sidewalk repairs required at the said
<br />residential properties and assess the total cost of the repairs against the lots or lands abutting thereon; and
<br />WHEREAS, plans, specifications, and cost estimates for the said sidewalk repairs have been filed
<br />with the Clerk of Council prior to the adoption of this Resolution;
<br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH
<br />OLM5TED, CUYAHOGA COUNTY, AND STATE OF OHIO:
<br />SECTION 1: lfiat the plans, specifications and cost estimates for the repairs to the sidewalks
<br />abutting upon the residenUal properties at Charles Road (Nos. 6507, 6523, 6603, 6635, 6652, 6684, 6700,
<br />6715, 6747) and Georgette Avenue ( Nos. 4404, 4626), are hereby approved.
<br />SECTION 2: That repairs to the sidewalks abutting upon the said residential properties shall be
<br />made by the owners of these properties in accordance with the specifications on file in the office of the
<br />Clerk of council.
<br />SECTION 3: That the repairs shall be made by the said owners within flurty (30) days from the
<br />date of service of notice upon said owners, as provided for in Section 729.03 of the Revised Code.
