PERMANENT STORMSEWER EASEMENT <br />%1VOW ALL MEN BY THESE PRESENTS: <br />THAT 7oseph M. & Dorothy Dickey, hereinafter collectively refened to as "Grantor," for <br />and in consideration of valuable consideration received to Grantor's full satisfactioq including <br />performance by the Grantee, at Grantee's expense, to the reasonable satisfaction of the Grantor, <br />of all the undertakings set forth in the letter to Grantor from Paul Deichmann, Engineer for <br />Grantee, of August 9, 1999 (hereinafter the "Work Letter"), receipt of which is hereby <br />acknowledged, <br />does hereby GRANT unto the City of North Olmsted, a municipal corporation, herein <br />referred to as "Grantee," and to its successors and assigns forever, a perpetual and permanent <br />easement on and under certain azeas of the lands owned by the Grantor and known as part of <br />Permanent Parcel No. 234-16-3, in the City of North Olmsted, Ohio, as described in Exhibits A <br />and B hereto, hereinafter known as the "Easement Parcel," for storm sewer purposes, together <br />with the right and privilege to enter upon or under the Easement Parcel for purposes of <br />constructioq inspection, repair, maintenance, and survey of said sewers and any appurtenances <br />thereto, upon the terms and conditions set forth herein, <br />TO HAVE AND HOLD said permanent easement and right-of-way unto the Grantee, its <br />successors and assigns forever. The Grantor themselves, and their successors and assigns, hereby <br />covenant with the said Grantee, its successors and assigns, that they are the lawful owners of the <br />Easement Parcel, and have full power to gant, bargain, sell, convey, and release the same in the <br />manner aforesaid and will warrant and defend the same against all claims. <br />The easement ganted is given for the purpose of allowing the Grantee the right to <br />construct, inspect, repair, operate, maintain, and survey a storm sewer, together with the <br />.0- .?*, .?.?., ?,?.?? ?,?... .. ... , .
