necessary manholes and appurtenances thereto, for the transportation of storm water with rights
<br />of ingress and egress on, over, and through the Easement Parcel for all purposes necessary and
<br />incident to the construction, maintenance, and operation and, from time to time, to alter, repair, or
<br />remove the same. All such construction, inspection, repair, operation, maintenance, surveying,
<br />and removal of the storm sewer shall be performed at times and in a manner that causes as little
<br />disturbance to the use and enjoyment of Grantor's land as is practicable under the circumstances.
<br />The construction of the storm sewer shall be commenced promptly and pursued diligently, and all
<br />such construction and installation shall be completed on or before December 1, 2000. Upon
<br />completion of construction, inspection, repair, operation, maintenance, or surveying of the sewer,
<br />all portions of the subsurface and surface area of the Easement Parcel and adjacent property that
<br />may have been excavated, damaged, or otherwise disturbed as a result of such construction shall
<br />be restored at the sole expense of Grantee to a substantially similar condition as existed prior to
<br />the construction.
<br />Grantee shall give Grantor reasonable notice, under the circumstances, of the
<br />commencement of any construction, inspection, repair, operation, maintenance, or surveying of
<br />the sewer. In the absence of an emergency, all constructioq inspection, repair, operation,
<br />maintenance, or surveying of the sewer shall be performed during daylight hours on weekdays.
<br />Grantor shall maintain, even during such work, reasonable access to the Easement Parcel, subject
<br />to Grantee's reasonable direction or orders regarding safety and protection of construction
<br />equipment, persons, or the general public.
<br />Grantee shall maintain the sewer and appurtenances thereto, and shall defend and hold
<br />Grantor harmless for any mechanic's liens or other liability resulting from any damages, losses,
<br />expenses, lawsuits, claims, or causes of action arising from or occasioned by the existence of the
