?.,.; <br />(3) Sales conducted pursuant to an order or process of a court of competent <br />jurisdiction. <br />719.03 PERMIT REQUIRED; COMPLIANCE; MAXIMUM NUMBER OF SALES. <br />(a) No person shall conduct a home and garage sale within a Residential Zoning <br />District or residential use in the City without first obtaining a permit from the <br />Director of Public Safety. <br />(b) No person who has obtained a permit shall violate any of the provisions of this <br />chapter. <br />(c) No home and garage sale shall be conducted by the same resident or a member <br />of the family of such resident on such resident's property or on another <br />resident's property more than twice each twelve-month period. <br />719.04 PERMIT APPLICATION; DISPLAY; ISSUANCE; DENIAL; APPEAL. <br />(a) The Director of Public Safety shall provide applications for permits for home <br />and garage sales and shall further provide a reasonable method for distributing <br />and receiving such applications. Such an application shall include the name of <br />the applicant, who shall be a resident of the City, his address, telephone <br />number, the date of the sale, the hours and duration of the sale, and the number <br />of times within the preceding twelve month period that a sale, as defined in this <br />chapter, has occurred on the property where the sale shall take place. Such <br />application for permit shall be submitted by the applicant to the Director of <br />Safety. There shall be no fee for such application. <br />(b) A duly organized homeowners association may, on behalf of its members, make <br />application for a permit in the name of the association for a sale that is <br />organized / run by the association provided that more than three residences <br />within the physical boundaries of the association are participating in the sale and <br />further provided that multiple residences are conducting the sales simultaneously <br />with respect to time and dates of sale. If an application is made by a <br />homeowners association, such an application shall include the name of the <br />association, a telephone number for the association, the date of the sale, and the <br />hours and duration of the sale. A permit issued to a homeowners association in <br />accordance with this section shall be counted as a sale under 719.03 to all <br />residences within the physical boundaries of the association. <br />(c) A single permit application that requests a sale lasting longer than one day, but <br />not more than three days, shall be treated as one sale for purposes of 719.03. <br />
