<br />(d) An application for permit shall be submitted to the Director of Safety not later <br />than twenty-four hours before the hour at which the sale is scheduled to begin. <br />(e) An application for permit that complies in all respects with the requirements of <br />this Chapter shall result in a permit being granted by the Director of Safety <br />within three business days of application being made for such permit. The date <br />of application shall be counted as the first business day in computing the time <br />for issuance of such permit. <br />( fl Once granted, a copy of the permit shall be submitted by the Director of Safety <br />to the Police Chief. <br />(g) Every permittee conducting a home and garage sale shall keep upon the licensed <br />premises the permit certificate and shall exhibit the same upon request. <br />(h) An application for permit that does not comply in all respects with this Chapter, <br />shall result in the permit not being granted by the Director of Safety. Within <br />three business days of application being made for such permit, written notice of <br />such permit denial shall be given to the applicant by certified mail or personal <br />service. The date of application shall be counted as the first business day in <br />computing the time for issuance of notice of such permit denial. The applicant <br />shall have the right to appeal such permit denial to the Board of Zoning Appeals <br />in accordance with the provisions of Section 1123.07 of the Zoning Code. The <br />Board shall have the power to affirm, modify, or reverse the decision of the <br />Director of Safety. Any such decision by the Board shall be final. <br />719.05 HOURS PERMITTED. <br />No person shall conduct a home and garage sale except between the hours of 8:00 a.m. <br />and 5:00 p.m., or as regulated by the Police Chief or a person designa.ted by him because of <br />traffic or weather conditions. No home and garage sale shall last more than three consecutive <br />days <br />719.99 PENALTY. <br />Whoever violates or fails to comply with any provision of this chapter is guilty of a <br />minor misdemeanor for a first offense; for a second offense, such person is guilty of a <br />misdemeanor of the fourth degree. <br />
