Musial, Mayor <br />May 10, 2000 <br />To: All of Council <br />From: Mayor Norm Musial 0/ <br />Subject: Ordinance No. 2000-23 (Garage Sales) <br />I ha.ve reviewed subject ordinance, ha.ve determined tha.t several questions must be <br />pursued and place my VETO thereon. <br />Garage sales seem to be an American institution. It can be looked upon as a social event <br />between neighbors and an easy way of securing additional funds for the household or <br />even a casual method for recycling household items. However, at some point, because <br />of frequency, garage sales at a residence can undergo a metamorphosis and becorne the <br />operation of a business within a residential district. If there aze situations wherein a few <br />residents are abusing the system by treating garage sales as a business, I would welcome <br />legislation specifically addressing this issue. In any event we must be cazeful to avoid, <br />under the guise of regulating garage sales, an unnecessary intrusion into the private lives <br />of our residents. <br />The Safety Directar is responsible for the administration of the Fire Department, Police <br />Department, Building Departrnent, Recreation Department and Springvale. I question <br />the wisdom of placing such a high priority of issuing garage sale permits in the same <br />category as the previously listed organizational segments. As a ma.tter of fact it would <br />appear that a reasonable number of garage sales should be three - that is one in the spring <br />(after spring cleaning), one in summer and one in fall in preparation for winter - rather <br />than two as set forth in Ordinance 2000-23. If one selects three as the number, perhaps <br />a permit should be required only for the third garage sale. <br />Bear in mind that even if the city limits the number of garage sales to two per residence, <br />that within a close proximity of ten homes (five across from each other) you could in <br />essence have twenty garage sales per year in the same general location. <br />In more specific terms, be advised as to the following: <br />a. 719.03 (c) -- In my opinion, monitoring the aspect of a resident or a member <br />of the family of such resident conducting a garage sale on another resident's <br />property is difficult, if not impossible to enforce. <br />0 "Together We Can Make A Difference!"
