?? <br />b. 719.04 (a) - In my opinion my Safety Director has more important items <br />under his responsibility than worrying about providing, coordinating and <br />tracking applications for garage sales. <br />c. 719.04(b) - In my opinion it is unfair for three residences of an association <br />under the association permit, ha.ving two gazage sales thereby precluding <br />others in the association to have even one garage sale. Further, the ordinance <br />is unfair and unreasonable wherein a voluntary association having two gazage <br />sales can take away the rights of non-members of said association from having <br />his or her oum garage sa.les. <br />d. 719.04(d) - The twenty four-hour periods may create undue stress on the <br />Safety Director. Suppose the applicant desires to have a garage sale on <br />Sunday. Conceivably, the applicant could be disturbing the peace and quiet <br />of the Safety Director twenty-four hours before on a Saturday morning by <br />approaching him with an application, thus intruding on his family life. <br />Further, 719.04(e) taken in combination' with 719.04(d) appeazs to create a <br />dilemma even Solomon would have difficulties with. For example if an <br />applicant provides the Safety Director with an application on Wednesday for a <br />garage sale on'Thursday, said Director has three business days or until Friday, <br />the day after the gazage sale, to approve the garage sale. <br />e. 719.04(fl - T"his section involves still more administrative time being taken <br />away from the Safety Director in relation to his other duties and <br />responsibilities. <br />f. 719.04(h) - In this section the submission of an application twenty-four hours <br />before the garage sale when taken into consideration that the Safety Director <br />has three business days to pmvide a written denial of a permit, not only can <br />keep the applicant in limbo, but potentially can cause the applicant to be <br />subject to a penalty because the permit denial didn't reach the applicant until <br />after the garage sale. <br />g. 719.99 PENALTY - As I understand penalties for misdemeanors, it troubles <br />me deeply that a person in violation of this ordinance governing garage sales <br />potentially couZd be thrown in jail for up to thirty (30) days plus paying a cash <br />fine. <br />With all of this said, I hereby place my VETO on Ordinance 2000-23. <br />?.. ??. <...?., . <br />:?...: _.
