CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2000-22 <br />BY.• MAYOR MUSIAL <br />AN ORDINANCE AMENDING ORDINANCE NO. 93-21 <br />WHICH AUTHORIZED THE MAYOR OF THE CITY OF <br />NORTH OLMSTED TO PARTICIPATE IN THE OHIO <br />DEPARTMENT OF TRANSPORTATION'S COOPERATIVE <br />PURCHASING PROGRAM, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the City of North Olmsted on March 16, 1993, adopted Ordinance No. 93- <br />21, which provided for the participation of the City in the Ohio Department of Transportation's <br />Cooperative Purchasing Program; and <br />WHEREAS, the State of Ohio has advised the Director of the Department of Service for <br />the City that, in order to continue participating in the program, the City must amend its enabling <br />legislation so as to further provide that the City will hold the Director of Transportation and the <br />Ohio Department of Transportation harmless for any claim or dispute arising out of participation <br />in a contract pursuant to Ohio Revised Code Section 5513.01(B); and <br />WHEREAS, the City desires to continue participating in the said program, which enables <br />the City to purchase machinery, materials and supplies at very competitive prices, and dces not <br />find the new State requirement to be overly onerous; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION ONE: That Ordinance Number 93-21 which presently reads as follows: <br />"SECTION 1: That the Mayor be and he is hereby authorized to participate in the Ohio <br />Department of Transportation's contracts for the purchase of machinery, materials, supplies or <br />other articles which the Department has entered into pursuant to Revised Code Section <br />5513.01(B). <br />SECTION 2. That the City of North Olmsted, through the Mayor, is authorized to enter <br />into an agreement with the Ohio Department of Transportation for the purposes of being bound by <br />the terms and conditions of the purchasing process as is prescribed by the Director of the <br />Department of Transportation.
