Ordinance No. 2000-22 SECTION 3. That the Director of Finance is hereby authorized, in the name of the City of North Olmsted, to directly pay to any vendor under each such contract of the Ohio Department of Transportation in which the City of North Olmsted participates for items it receives pursuant to said contract. SECTION 4. That this ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that it is immediately necessary for the Ciry to avail itself of cost saving methods regarding the purchase of machinery, materials and supplies, etc., and further provided that it receives the aff'?rmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor. " Be amended and, as amended, sha11 read as follows: "SECTION 1: That the Mayor be and he is hereby authorized to participate in the Ohio Department of Transportation's contracts for the purchase of machinery, materials, supplies or other articles which the Department has entered into pursuant to Revised Code Section 5513.01(B). SECTION 2. That the City of North Olmsted, through the Mayor, is authorized to enter into an agreement with the Ohio Department of Transportation for the purposes of being bound by the terms and conditions of the purchasing process as is prescribed by the Director of the Department of Transportation. SECTION 3. That the Director of Finance is hereby authorized, in the name of the City of North Olmsted, to directly pay to any vendor under each such contract of the Ohio Department of Transportation in which the City of North Olmsted participates for items it receives pursuant to said contract. SECTION 4. That the City of North Olmsted agrees to hold the Director of Transportation and the Ohio Department harmless for any claim or dispute arising out of participation in a contract pursuant to Ohio Revised Code Section 5513.01(B). SECTION 5. That this Ordinance is hereby declazed to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that it is immediately necessary for the City to avail itself of cost saving methods regarding the purchase of machinery, materials and supplies, etc., and further provided that it receives the affirmative vote of two-thirds of a11 members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor." 2
