application. The Building Commissioner shall issue a written statement <br />contemporaneous with his decision, explaining the reasons for revocation. <br />1163.10 NONCONFORMING SIGNS. <br />Nonconforming signs may be maintained, except: <br />(a) No nonconforming sign or part thereof shall be altered, modified, relocated, <br />or changed in any manner whatsoever in any process of reconstruction, repair, <br />maintenance, or restoration, when the cost of said reconstruction, repair, maintenance, <br />or restoration exceeds fifty percent (50%) of the sign's replacement cost, unless the <br />entire sign shall be brought into compliance with all of the provisions of this Chapter, <br />and all other applicable City laws and ordinances. <br />(b) Any nonconforming sign the use of which is discontinued for a period of <br />thirty (30) days or more shall either be removed or brought into compliance with all of <br />the provisions of this Chapter and all other applicable City laws and ordinances. <br />(c) Any nonconforming sign for a property or premises that undergoes a change <br />of use (permitted), as that term is defined in this Zoning Code, shall be brought into <br />compliance with all of the provisions of this Chapter and all other applicable City laws <br />and ordinances. <br />1163.11 REMOVAL OF SIGNS. <br />The Building Commissioner is authorized to order the removal, repair or <br />maintenance of any sign which constitutes a nuisance, or for which the required permit <br />has not been obtained, or which is violative of any provision in Sections 1163.13 <br />through 1163.23 of this Chapter. Every such order shall be served upon the owner or <br />person in possession of the sign by personal or certified mail service, provided that, <br />where service has been refused or unclaimed, no further service or notice shall be <br />required, and the time for compliance shall commence from the date such service <br />refusal or failure of claim is entered in the records of the Building Department. <br />Whenever the removal, repair or maintenance of any permanent sign has been <br />ordered by the Building Commissioner, the owner or person in possession of such sign <br />shall comply with such order within fourteen (14) days after notice is served upon him. <br />Whenever the removal, repair or maintenance of a temporary or portable sign has been <br />ordered by the Building Commissioner, the owner or person in possession of such sign <br />shall comply with the order within forty-eight (48) hours after notice is served upon <br />him. In the event of noncompliance, the Building Commissioner may seek an order of <br />removal from a court of competent jurisdiction, or may pursue criminal action against <br />the owner and/ or person in possession in accordance with the appropriate provisions <br />of this Zoning Code relating to Code violations. If, following an inspection, the <br />Building Commissioner determines that any sign constitutes an immediate danger to <br />the public safety, the Building Commissioner may effect the immediate removal of said <br />sign without regard to the time intervals for compliance cited above, at the sign owner's <br />8 <br />,..?...:. ... ., . .
