?x. <br />reasonable manner and for a reasonable time in its performance of any required maintenance or <br />repairs. <br />The recitation of these additional remedies for the breach of this Agreement sha11 not be <br />construed as a limitation upon any other remedies which North Olmsted may have available to it <br />under law or in equity for such a breach. <br />SECTION VII - COOPERATION <br />North Ridgeville and North Olmsted mutually agree to take all necessary steps and to <br />mutually cooperate in good faith in the dedication and acceptance of the proposed Cypress Avenue <br />as a public roadway. <br />SECTION VIII - APPROVAL REOiJIItED <br />North Ridgeville and North Olmsted agree that the entering into of this Agreement dces <br />not guarantee the acceptance of the pmposal dedicated public roadway currently identified as <br />Cypress Avenue; however, if it is constructed in accordance with the appmpriate plan(s) and <br />applicable laws, North Olmsted and North Ridgeville will utilize their respective best efforts to <br />obtain approval by their respective city councils of such ordinance(s) accepting the proposed <br />dedicated public roadway cunendy identified as Cypress Avenue. <br />SECTION IX - LENGTH OF AGREEMENT <br />North Ridgeville and North Olmsted both intend to agree to allow North Ridgeville to use <br />its powers and authority under Section 719.01 of the Ohio Revised Code to alter the boundaries <br />between the communities so that the portion of North Olmsted containing Cypress Avenue, <br />together with the remainder of the property owned by Q-Panel Lab Products Corporation that is <br />currently located in North Olmsted, shall become a part of the City of North Ridgeville. <br />Accordingly, this Agreement shall remain in full force and effect so long and until the respective <br />Page -4- <br />. ?..;
