cities adjust their respective boundaries so that all of the proposed dedicated public roadway <br />currently identified as Cypress Avenue becomes a part of the limits of the City of North <br />Ridgeville. <br />SECTION X - ENTIRE AGREEMENT <br />This Agreement constitutes the entire agreement between North Ridgeville and North <br />Olmsted with respect to the proposed dedicated public roadway currently identified as Cypress <br />Avenue to which it relates. The parties hereto agree that no representation or warranties shall be <br />binding upon either party unless expressed in writing this instrument. <br />SECTION XI - MODIFICATIONS <br />No changes in, modifications, extension, supplement to, or discharge of this Agreement <br />shall be valid or enforceable unless in writing and duly executed on behalf of North Ridgeville and <br />North Olmsted. <br />SECTION XII - GOVERNING LAW <br />lfiis Agreement is to be interpreted and construed in accordance with the law of the State <br />of Ohio. <br />SECTION XIII - SEVERABILITY <br />If any term or provision of this Agreement shall become or be declared by a court of law <br />to be invalid or unenforceable, the remainder of this Agreement and the application of the <br />remainder of this Agreement shall not be affected thereby, and each term and provision of this <br />Agreement shall be valid and shall be enforceable to the fullest extent permitted by law. <br />Page -5- <br />.. <br />??
