- ?„ <br />CHAPTER 1140 <br />Public Facilities Overlay District <br />1140.01 Intent. 1140.05 Area Regulations. <br />1140.02 Preemption. 1140.06 Yard Regulations. <br />1140.03 Permitted Uses. 1140.07 Signage. <br />1140.04 Height Regulations. <br />CROSS REFERENCES <br />Public Facility as Conditionally Permitted Use in Residential District - see P& Z 1135.01(c) <br />Regulation of Signage - see P& Z 1163.01 et seq. <br />1140.01 INTENT. <br />Public Facilities Districts and their regulations are established herein in order to achieve, <br />among others, the following purposes: <br />(a) To provide proper zoning classifications for governmental, civic, health, welfare, <br />educational, and recreational facilities in proper locations and to an extent so as to promote the <br />general health, safety, convenience, comfort, and welfare of residents and visitors of the City; <br />(b) To protect adjacent residential, commercial, and semi-public areas by regulating <br />the bulk and spacing of public facilities, particularly at common boundaries; <br />(c) To protect and improve property values; <br />(d) To protect public and semipublic facilities from encroachment by other uses; <br />(e) To assure that public and semipublic uses shall be compatible with adjoining <br />residential uses; <br />( fl To maintain the aesthetic appearance of the City, including, but not limited to, its <br />residential character, unobstructed open spaces, and attractive commercial and office/industrial <br />areas; <br />(g) To alert the public to the location of parcels either intended for or currently being <br />used for public facilities; <br />(h) To promote the most desirable land use and traffic patterns in accordance with the <br />City's Planning and Development Program. <br />1140.02 PREEMPTION. <br />(a) Where applicable, the regulations governing the Public Facilities Overlay District <br />shall control and supersede wherever inconsistent with any other portion or provision of the <br />Zoning Code. <br />(b) If no inconsistency exists between the provisions of the Overlay District and the <br />underlying Zoning District, the underlying Zoning District regulations shall remain in full force <br />and effect and shall regulate all land use and development.
