<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 99-111 <br />BY: COUNCILMAN PAUL MILLER. <br />AN ORDINANCE CREATING NEW SECTION 337.30 OF THE <br />TRAFFIC CODE OF THE CITY OF NORTH OLMSTED SO AS <br />TO PROHIBIT THE EXCESSIVELY LOUD PLAYING OF <br />SOUND DEVICES WHILE OPERATING MOTOR VEHICLES, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the excessively loud playing of "boom boxes" and other sound devices while <br />operating motor vehicles on public streets and at public places creates traffic safety hazards; and <br />WHEREAS, it is the desire of this Council to prohibit the excessively loud playing of <br />"boom boxes" and other sound devices while operating motor vehicles on roads and at public <br />places located in the City of North Olmsted; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That there be, and hereby is, created new Section 337.30 of the Traffic <br />Code of the City of North Olmsted, which shall read in its entirety as follows: <br />"337.30 PLAYING OF SOUND DEVICES IN MOTOR VEHICLES <br />PROHIBITED; WHEN. <br />(a) No person shall play any radio, music player, cd player, audio system, or any other <br />type of sound device by whatever named called, in a motor vehicle on any road or at any place <br />open to the public at such volume as to disturb the quiet, comfort or repose of persons of ordinary <br />sensibilities or at a volume which is plainly audible to persons other than the occupants of said <br />vehicle. <br />(b) Whoever violates paragraph (a) shall, upon first offense, be guilty of a minor <br />misdemeanor and shall be fined a minimum mandatory seventy-five dollars ($75.00), which fine <br />shall not be suspended, waived or otherwise reduced belnw that amount. Whoever violates <br />paragraph (a) within thirty-six (36) hours after having been charged with a first offense thereof <br />or within thirty-six (36) hours after having been wa.rned by a police officer to desist from violating <br />the provisions of said paragraph (a), sha11 be guilty of a misdemeanor of the fourth degree and she <br />be fined a minimum mandatory one hundred fifty dollars ($150.00), but no more than five <br />?
