hundred dollars ($500.00), which minimum mandatory amount shall not be suspended, waived <br />or otherwise reduced. Whoever violates paragraph (a) shall, upon a subsequent offense which <br />does not occur within thirty-suc (36) hours after having been charged with a first offense thereof <br />or within thirty-six (36) hours after having been warned by a police officer to desist from violating <br />the provisions of said paragraph (a), be fined not less than a minimum mandatory one hundred <br />dollars ($100.00) and not more than five hundred dollars ($500.00), which minimum mandatory <br />amount shall not be suspended, waived or otherwise reduced. Each day upon which a violation <br />occurs or continues shall be a separate offense and punishable as such hereunder. <br />SECTION 2: That any Ordinance, or part of any Ordinance, which is inconsistent with <br />or in conflict with this Ordinance, shall, to the extent of any such inconsistency or conflict, be, <br />and hereby is, repealed. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to enact this legislation to provide a law <br />enforcement tool for the police to use against excessive noise generated by sound devices in motor <br />vehicles on the public roads of the City of North Olmsted, which this Council believes causes an <br />increased risk of traffic accidents on the roads; and further provided it receives the affirmative <br />vote of two-thirds of a11 members of Council, it sha11 take effect and be in force immediately upon <br />its passage and approval by the Mayor. <br />PASSED: <br />ATTEST.• <br />? <br />BARBARA L.
