<br />G?Ca' 4 fo 1/0 s- <br />C, I TY O F NOR T H O L MS T E D <br />ORDINANG'ENO. 99-110 <br />BY COUNC,'ILMANPAUL 1N7I,T.F.R <br />AN ORDINANCE GREATING 1VEW SECTION 1119.06 OF TSE <br />NORTS OLMSTED Z0IVING CODE REQUIRING T'SAT <br />DEYELOPERS REPORT CERTAIN INCOME TAX <br />INFORMATION TD TSE CIT'P PRIOR TO OBTAINING <br />OCCUPANCY PERMITS FOLLOWIZVG COMMERQAL <br />CONSTRUCTION OR NEW RESIDENTIAL CONSTRUCTION <br />INTHE GITYASAMENDED. <br />WEERF.AS, this Council has been apprized that this City each year loses substantial <br />amounts of income tax revenues because developers, contractors, and subcontractors fail to <br />properly withhold and report income earned by employees working at construction sites within <br />the City; and <br />WHEREAS, this Council desires to impose a requirement on developers to gather and <br />provide the Director of Finance with information which will enable her to work with the Regional <br />Income Tax Agency (RITA) and other central collections agencies to ascertain whether the <br />employees of developers, owners, contractors and subcontractors, who work at construction sites in <br />the City, are paying a11 of the income taxes which are due to the City of North Olmsted; and <br />WRExF.AS, this Council believes that withholding occupancy permits from applicants <br />until such times as the applicants for said permits provide the Director of Finance with necessary <br />tax-related information concerning employees working at construction sites in the City is <br />reasonable and will serve to assure that such information is timely and accurately reported; and <br />a7LF.RF.AS, it is the desire of this Council to amend the City Zoning Code to include the <br />provisions which follow herein conditioning the issuance of occupancy permits upon the reporting <br />of such taac information; and <br />WH?RF.,4S, after careful consideration, the Planning Commission of the City, on the <br />day of , 1999, recommended approval of the following amendment to the Zoning <br />Code. <br />NOA', TSERF.FpRE, BE IT ORDAINED BY THE COUNCIL OF TSE GITY OF <br />NORTSOLMSTED, CUYAHOGA COUNTY, AND STATE OFOffiO: <br />
