.??. <br />QTYOFNORTHOLMSTED <br />ORDINANCE NO. 99-106 <br />BY COUNCILMANPAUL ARLr F.R <br />AN pRDINANG'E CREATING 1VEW SECTION 1139.12 OF TSE <br />NORTS OLMSTED ZONING CODE REGULATING THE <br />LOCATION OF FREE-STANDING INDtTS77eIAT•17.t?n UIVITS <br />ONCOMMERCIAL PROPERTI; AS T'WIGEAMENDED. <br />wHF.xF.,4S, one property owner in the City of North Olmsted has recenfly applied for a <br />permit to locate an industrialized unit upon its property located in the City's General Retail <br />Business District; and <br />WHEREAS, the City's Zoning Code is presently silent on the subject of the placement and <br />other regulation of such free-standing industrialized units on commercial property; and <br />WAF.RF.,4S, this Council finds, upon study and review, that the placement of such units as <br />the primary buildings on commercial property, and/or within view of public right-of-ways, and/or <br />without sufficient landscaping, has a negative impact on the aesthetics of the City's General Retail <br />Business district and adversely affects property values in the district; and <br />agiERE,4S, it is the desire of this Council to amend the City Zoning Code to include the <br />provisions which follow herein regulating the placement of free-standing industrialized units on <br />commercial property; and <br />WAEREAS, after careful consideration, the Planning Commission of the City, on the dJ? <br />day of 1999, recommended approval of the following amendment to the Zoning <br />Code. ' <br />NOW, 7'NF.'RF.FOREo BE IT ORDAINED BY THE COUNCIL OF TSE GITY OF <br />NORTSOLMSTED, CUYAHOGA COUNTY, AND STATE OF OglO: <br />SECZWX_L. That there be and hereby is created new Sections 1139.12 of the Zoning <br />Code of the City of North Olmsted, which sha11 read in its entirety as follows: <br />1139.12 REGULATION OF FREE-STANDING INDUSTRIALIZED UNITS. <br />(a) For purposes of this section, the term "industrialized unit" shall have the same <br />meaning as found at Section 4101:2-1-55 of the Ohio Administrative Code. "Industrialized units" <br />sha11 include trailers, whether on wheels or not, and whether permanently affixed to the ground or <br />not. <br />(b) One free-standing industrialized unit shall be permitted on property which is zoned for <br />General Retail Business use, provided: <br />(i) such unit is not used as the main building on the property; <br />(ii) such unit is located no closer than one hundred (100) feet from every public right-of- <br />way; <br />(iii) such unit is surrounded on all sides with landscaping approved by the City Planning <br />Commission; and <br />
