, .. <br />6- ?O `7' <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 99-79 <br />By: Councilmember Gareau <br />AN ORDINANCE CREATING CHAPTER 556 OF THE <br />GENERAL OFFENSES CODE OF THE CTIY OF NORTH <br />OLMSTED, ErJTITLED "LIGHTING NIIISANCE COIVTROL, " <br />AND DECI.ARINGANEMERGENCY, ASAMENDED. <br />WHERF,A.S', former Councilman Ronald Tallon, while on this Council and the City Planning <br />Commission, conducted extensive research and reviewed various model code provisions relating to the <br />cornrol of commercial exterior lighting and its adverse impact upon adjacent resideYrtial properties; and <br />WHERF.fLS, this Council has further conducted its own research into the well-documerned <br />adverse effects of nuisance lighting upon residential properties; and <br />WHEREAS, upon review, this Cauncil expressly finds that lighting, much like noise, if not <br />confined to the premises from which it originates, causes nuisarice conditions to exist upon neighboring <br />residential properties, substazrtially urterfeiing with the owner or occupier's enjoymerrt of the use of the <br />property, and further is injurious to the public health, safety and welfaze of the community; and <br />R'HERF9.S, this Council accordingly desires to enact legislation to regulate commercial <br />exterior lighting as it impacts upon residential properties in the City of North Olmsted by prohibiting <br />commercial property ovmers to cause, or suffer to exist, lighting nuisances upon residential property in <br />the form of light trespass and glaze, and to impose criminal penalties for violations thereof; <br />NOW, THEREFORE, BE IT ORDAlNED BY THE COUNCIL OF THE CITY OF <br />NORTH OI MSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECT70N 1: T'hat there be and hereby is createl Chapter 556 of the General Offenses Code, <br />entitled "Lighting Nuisance Control," which, as created, shall read in its entirety as follows: <br />"CHAPTER 556 <br />Lighting Nuisance Control <br />556.01 LEGISLATIVE FINDINGS AND l]vTENT; RESPONSIBII.,ITIES OF <br />PROPERTY OWNERS. <br />r .?;???? .n. ?.>?,A?x????... ,?,:?i. _. rt???. . •.??? . ... ..._,? .
