?a :-?i....... <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 99-77 <br />BY.• Council Member Gareau <br /> <br />AN ORDINANCE AMENDING SECfilONS 1126 02 AND <br />1161.12 OF THE NORTH OLMSTED ZONING CODE <br />RELATING TO COMMERCIAL LIGHTING STRUCTURES, AS <br />AMENDED. <br />WHF.RF.AS, former Councilman Ronald Ta11on, while serving on this Council and on the <br />City Planning Commission, conducted extensive research and reviewed various model code <br />provisions relating to the control of commercial exterior lighting and its impact upon adjacent <br />residerrtial property; and <br />AP?R?AS, this Council, having had the benefit of Mr. Ta11on's research and review, and <br />his conclusions therefrom, and having conducted its own research into model lighting ordinances, <br />desires to enact legislation to better control exterior lighting upon commercially-zoned properties, <br />particularly as it impacts upon residential properties in the City of North Olmsted, by, among other <br />things, regulating luminaire heights and illumination levels; and <br />ATHF.RF.,4S, it is further the desire of this Council to amend the Zoning Code to include the <br />provisions which follow herein; and <br />WHER1?AS, that this Ordinance amending Sections 1126.02 and 11611.12 of the Zoning <br />Code is deemed to be approved by the Planning Commission as formal action was not taken within <br />30 days of referral from City Council; and <br />WHEREAS, following publication of newspaper notice in conformance with the <br />provisions of Section 14 of Article IV of the,Qarter and Section 1127.03 of the Zoning Code, a <br />public hearing was held on the JL day of 2003; <br />NOA', TSEREFORE, BE Tl ORDAINED BY TBE COUNGIL OF TSE QTY OF <br />NORTS OLMSTED, CUYAHOGA COUNTY, AND STATE OF OffiO: <br />SECTION 1: That Sections 1126.02 and 1161.12 of the Zoning Code of the City of North <br />Olmsted, which presently read as follows: <br />"1126.02 DRAWINGS, ETC. TO ACCOMPANY A.PPLICATION. <br />Application for building permits required under Section 1126.01 shall be accompanied by such <br />drawings, sketches, plans, including landscaping plans, renderings, photographs, material <br />samples, and other items as shall be reasonably required by rule of the Building Official in order <br />
