adverse impact upon any Landmarks located in the district, it shall issue a Certificate of <br />Appropriateness. <br />b) Review of Building and Demolition Permit Applications. If the Commission <br />receives from the Building Commissioner an application for a demolition permit (as described in <br />subsection (a)(4) of Section 165.07), within fifteen (15) days of receipt of the permit application <br />by the Commission, the Commission shall designate a time, place and date for a public hearing. <br />The public hearing date shall be no longer than forty-five (45) days from the date of receipt of the <br />permit application by the Commission. If the permit application is for an alteration other than <br />demolition (as described in subsections (a)(3) and (a)(5) of Section 165.07), the Commission <br />shall, within fifteen (15) days of receipt of the permit application: <br />1) Issue a Certificate of Appropriateness, if the Commission finds that the <br />proposed work is compatible with the character of the Landmark District as described in the <br />designating ordinance, and will have no adverse impact upon any Landmarks located in the <br />district within 500 feet of the proposed work site; or <br />2) Designate a time, date and place for a public hearing ta be held no longer <br />than forty-five (45) days from the date of receipt of the permit application by the commission. <br />c} Action by Commission. The Commission's review of building permit applications <br />for proposed work, as set forth in subsections (a)(3), (a)(4) and (a)(5) of Section 165.07, shall be <br />subject to the public hearing requirements of Section 165.10. Following said hearing, the <br />Commission, within thirty (30) days after said hearing, shall make findings and a recommendation <br />to approve or deny the application for a building or demolition permit. The findings of the <br />Commission shall be based upon its consideration of the criteria specifically set forth in Section <br />165.10 or elsewhere within this Chapter. <br />d) Action by Building Commissioner. Upon receiving the findings and <br />recommendations of the Commission, the Building Commissioner shall further process the <br />applicant's building or demolition permit application in accordance with the other applicable laws <br />of the City; provided, however, that a demolition permit sha11 not be issued without a building <br />permit having prior thereto been first approved and issued for a building or structure to replace <br />the building or structure scheduled for demolition. <br />16510 PUBLIC HEARING REQUIItEMENTS; APPEALS. <br />a) Commission to Conduct Hearings. Public hearings of the Commission are to be <br />conducted by the Commission itself or by such members or member it designates; provided, <br />however, that if such public hearing is not conducted by the entire Commission, the person so <br />conducting it shall transmit a written report thereupon and forthwith to all Commission members. <br />The Commission or its designated member conducting the hearing may adopt such rules or limits <br />as may be necessary to govern the hearing within the proper spirit and purposes of this Chapter. <br />b) Notification of Hearings of the Commission. Written notice of public hearings of <br />the Commission shall be sent to the owner of the property and to the building permit applicant (if <br />different from the owner), giving the time, date, place and subject of the public hearing, not less <br />than fifteen (15) days prior to the hearing. In addition, a sign indicating the proposed action and <br />the time, date and place of the hearing shall be posted by the owner or applicant on the property <br />being considered not less than seven (7) days prior to the hearing. Such signs shall be on a form <br />provided by the Commission and shall be prominently displayed and easily readable from abutting <br />public ways. <br />11 <br />?
