<br />c) Deternunations of Commission.. The findings, reports, recommendations and <br />other determinations of the Commission shall be based upon consideration of specified design <br />standards, presented plans, public testimony and related findings of fact. Notification of all <br />Commission determinations shall be made in writing to the applicant, to such other persons who <br />have in writing requested notification of Commission determinations, and to the Building <br />Commissioner within five (5) days after the determination. <br />d) Criteria for determining appropriateness of proposed work. In determining the <br />compatibility and impact of work as proposed in an application for a building permit, the <br />Commission shall consider only the following: <br />1) All plans, drawings and photographs as may be submitted by the applicant, <br />city officials, or others; <br />2) Information presented at a public hearing held concerning the proposed <br />work; <br />3) The purpose of this Chapter; <br />4) The criteria used in the original designation of the district in which the <br />property under consideration is situated; <br />5) The historical and architectural style, the general design, arrangement, <br />texture, materials and color of the building or structure in question or its appurtenant fixtures; the <br />relationship of such features to similar features of the other buildings witlun the district and the <br />position of the building, structure, park or open space in relation to public rights-of-way and to <br />other buildings and structures in the district; <br />6) The effects of the proposed work upon the protection, enhancement, <br />perpetuation and use of the district which cause it to possess a special character or special <br />historical or aesthetic interest or value; <br />7) Whether denial of the permit will involve substantial hardship to the <br />applicant, and whether issuance of the permit would act to the substantial detriment of the public <br />welfare and would be contrary to the intent and purposes of this chapter; and <br />8) Such other criteria as are set forth in Section 165.11 which are relevant to <br />the proposed work. <br />e) Extensions. Any time limits set forth in this Chapter for hearings may be extencled <br />by mutual consent of the Commission and the applicant, or unilaterally by the Commission as a <br />result of delay attributable to the applicant. Such extensions shall either be in writing or shall <br />otherwise affirmatively appear on the face of the records of the Commission's proceedings. <br />f) Anneals. To the extent that any determination of the Commission, as described in <br />paragraph (c) above, taken following a public hearing substantially affects a property right of an <br />applicant or other interested party, the deternunation may be appealed by the applicant, the City, <br />or such other interested party to the Court of Common Pleas pursuant to the provisions of <br />Chapter 2506 of the Ohio Revised Code. <br />165.11 DE5IGN GUIDELINES AND DEMOLITION CRITERIA. <br />a) Preface. The purpose of these additional guidelines is to preserve the architectural <br />history of existing buildings or structures and to insure the procedures and materials used are <br />compatible with the existing building or structure and help to ensure its preservation into the <br />future and are meant to give architects and owners design direction consistent with this Chapter <br />165 of the Codified Ordinances of the City of North Olmsted.
