CITY OF NORTH OLMSTED <br />ORDINANCE NO. 99-37 <br />BY: COUNCILMAN DEAN MCKAY <br />AN ORDINANCE AMENDING SECTION 741.03 OF <br />CHAPTER 741 OF THE BUSINESS REGULATION CODE OF <br />THE CITY OF NORTH OLMSTED, ENTITLED <br />"DELIVERIES TO COMMERCIAL ESTABLISHMENTS, " SO <br />AS TO PROHIBIT MAKING OR RECEIVING DELIVERIES, <br />OR RUNNING ENGINES OF MOTOR VEHICLES, NEAR <br />RESIDENCES BETWEEN THE HOURS OF 9:00 PM AND <br />7:00 AM, AND DECLARING AN EMERGENCY AS <br />AMENDED. <br />WHEREAS, the City has received complaints from residents living near commercial <br />establishments regarding the running of truck engines during late night and early morning <br />hours; and <br />WHEREAS, this Council, having investigated the matter, finds that such activity <br />creates an unreasonable amount of noise which interferes with the lawful use, enjoyment, and <br />tranquility of residential neighborhoods, and is therefore a nuisance which should be <br />prohibited; and <br />WHEREAS, Section 741.03 of Chapter 741 of the Business Regulation Code, entitled <br />"Deliveries to Commercial Establishments, as presently constituted does not prohibit this <br />nuisance activity; and <br />WHEREAS, this Council wishes to establish hours of prohibition for commercial <br />deliveries which are consistent with those found in Section 555.03(e) and (fl of Chapter 555 of <br />the General Offenses Code, entitled, "Noise Control;" <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO. <br />
