<br />SECTION I: That Section 741.03 of Chapter 741 of the Business Regulation Code, <br />entitled "Deliveries to Commerciai Establishments," which presently reads as follows: <br />"741.03 PROHIBITIONS. <br />(a) No person shall deliver or cause to be delivered, or accept delivery of, any <br />goods or merchandise to or at a commercial establishment within 250 feet of a residential <br />building between the hours of 11:00 p.m. and 7:00 a.m. <br />(b) No person making deliveries or receiving deliveries at any time shall permit the <br />engine or a motor vehicle to remain running for more than ten minutes while waiting to make <br />or receive deliveries between 11:00 p.m. and 7:00 a.m. <br />(c) Every owner and tenant of a commercial establishment located within 250 feet <br />of a residential buiiding shall post, or cause to be posted, a sign or signs stating, "No <br />Deiiveries or Pick-ups or Running Engines more than Ten (10) Minutes Between 11:00 p.m. <br />and 7:00 a.m.". A sign or signs shall be required to be posted on the building of the <br />commercial establishment where deliveries or pick-ups are made and/or where trash is <br />removed. The height of the sign or signs is to be at eye level with truck traffic." <br />be amended, and as amended, shall read as follows: <br />"741.03 PROHIBITIONS. <br />(a) No person shall deliver or cause to be delivered, or accept delivery of, any <br />goods or merchandise to or at a commercial establishment within 250 feet of a residential <br />building between the hours of 9:00 p.m. and 7:00 a.m. <br />(b) No person, while waiting to make or receive deliveries at a commercial <br />establishment shall permit the engine or a motor vehicle, if it is located within 250 feet of a <br />residential building, to remain running for any length of time between 9:00 p.m. and 7:00 a.m. <br />(c) Every owner and tenant of a commercial establishment located within 250 feet <br />of a residential building shall post, or cause to be posted, a sign or signs stating, "No <br />Deliveries or Pick-ups or Running of Engines Between 9:00 p.m. and 7:00 a.m.". A sign or <br />signs shall be posted on the building of the commercial establishment where deliveries or pick- <br />ups are made and/or where trash is removed. The height of the sign or signs shall be at eye <br />level with truck traffic." <br />2 <br />
