Grievance shall automatically move on to the next step. The time limits specified for <br />either pariy may be extended only by written muh?al ageement. <br />H. This procedure shail not be used for the purpose of addinb to. subtracting from, or <br />altering in ar?y way of the provisions of this Agreement. <br />7.; All Griec°ances shall be administered in accordance with the following steps: <br />STEP 1- The Grievance shall be discussed between the Employee involved and an Association <br />representauve of lus choice, and his Shift Officer witlun seven davs of the accurrence on which <br />the Grievance is basetl. If a setilement satisfactony to the parties cannot he reached within three <br />days of the inirial presentation of the Grievance, the Aggrieved Party shali reduce the Grievance to <br />writuig as per Section 7.2 (A) and submit his written grievance to the Shifi Officer. The Sluft <br />Officer shall indicate the date and time of receipt of the grievance, and affix lus sigiiature to the <br />grievance form, and within seven days submit the grievance to the Fire Ciiief with a«-ritten report <br />stating the substance of the grievance and any necessary background inforniation dhat mav be <br />pertinent to the grievance. Copies of ans- written statements and documents shall be pro-Nrided to <br />the aggrieved party as well. Written grievances can not be resolved at STEP 1 of the grievance <br />procedure. <br />In the event of an Employee's discharge from emploVment the Grievance shall be submitted at <br />Step 3 with a cNz-itten Grievance submitted to the D'uector of Public Safcty within seven ciays of <br />the discharge of the Employee. <br />STEP 2- The Fire Chief shall render a Nvritten decision within seven day°s :ifter receipt of the <br />Grievance. The fire chief may convene a hearing during that seven day periad with the aggrieved <br />party and an Association representative of the aggrieved party's choice. <br />$TEP 3- If the Aggrieved Party initiating the Grievance is not satisfied widi the written decision <br />of the Fire Chief at the conclusion of Step 2, a written appeal of the decision may be filed with the <br />Director of Pubiic Safety within seven days from the date of the written decision rendered by the <br />Fire Chief at Step 2. Copies of the written decision shall be submitted Aridi the appeal. <br />'I'he Director of Public Safety shall com-ene a hearing witlun seven days of the receipt of the <br />appeal. The hearing will be held with the Aggrieved Party and his Association representative. if a <br />representatiti•e is requested. The Director of Public Safety shall issue awritten decision to the <br />Employee and his representative if requested Nrithin seven days from the date of the hearing. <br />10
