ARTICLE tIIII <br />PERSONNEL REDUCTION <br />8.1 When a position in the Fire Department is abolished, and the position is above the rank of Fire <br />Fighter, the least Senior officer in stich rank shall be demoted to the next Iower rank and the least <br />Senior officer in such lower rank shall be demoted, and so on do«m until dhe least Senior person <br />has been reached and he shall be laid off. <br />8.2 When a Fire Fighter's position, or Fire Cadet/Paramedic, has been abolished aild is re-established <br />the person who previously held that position shall be entitled to that pasition. If a position above <br />the rank of Fire Fighter is abolished, theii re-established, the person who previously held tilat <br />posuion shall be entitled to that position. No new Employees shall be tiired untii all laid off <br />Employees within that classification have been given the oppornuiity to return to work. Any <br />Empioyee taid off for more that durty-sis consecutive months shall not be called to retuni to work. <br />8.3 Any Employee who has been laid off shall be subject to the tenns and regulations of the <br />Consolidated Omnibus Budget Reconciliation Act (COBRA). <br />8.4 Any Employee laid off and subsequently recalled to work: shali return to tivork -%vith all benefiis <br />and privileges previously ]ield provided dhe same have not been used, including bzit not limited to <br />seniority, accumulated sick leave, holidays and vacation rights. <br />8.5 Emplovee must report all address and telephone changes while laid off. <br />8.6 Employee must agrce to return to work wilhin 48 hours of recall or lose his right of recall. <br />Emplo,yee niast retum to work wzthin 14 days of the date of recall or lose his rigtit to recall. <br />ARTICLE IX <br />DISCIPLINE AND DISCIiARGE <br />9.1 No Employee shall be disciplined or discharged Nvithout just cause. <br />12 <br />
