9.2 Iii all cases whereby tlie Employer takes discipl'ulary action against a member of tlus bargauiing <br />unit which results in the suspension or discharge of a non-probationary Employee, the Employee <br />shall receive a written notificaiion detailing the cause for the suspension or discharge and the <br />effective date of the suspension or discharge. <br />9.; In a case where the Employer takes disciplinary action resulting in suspension or discharge of a <br />non-probationarv Employee, the non-prabationary Employee shall have a right to appeal such <br />discipluiary action through the Grievance Ptocedure beginning at 5tep 3 and shall be filed in <br />accordance Nvith the time limits established in Step 1 of the Grievance Procedure. Verbal and/or <br />written reprimands that do not in themselves result in suspension or discharge shall not be subject <br />to the Grievance Procedure. <br />9.4 An Employee that has been suspended and/or discharged atui chooses to file a Grievance, shall be <br />pernutted to, at his option, be allowed to call wimesses to present testimony relating to the <br />suspension and/or discharge at the hearing. The Employer shall also be pernutted to call witnesses <br />to provide testimony relative to the suspension and/or discharge. Witziess lists establishett by dhe <br />Citv or the Grievant shall be exchanged 5 days prior to the hearing Na other witnesses shall be <br />pennitted to testify unless so listed, or unless agreed upon by both parties, or unless called by <br />either party as a rebuttal wimess. <br />9.5 Failure of an Employee to comply with the provisians of this Article and the provisions contained <br />within Article VII of this Agreement shall result in unmediate forfeiture of further right of appeal. <br />9.6 Failure of the Employer to compl_y with the provision contained in Section 9.2 above shall result un <br />renderuig the suspension and/or termination null and void <br />9,7 T1ie time limits set forth within the Grievance Procedure (Article VII) may be modified by written <br />mutual agreement of the Association and the Employer. <br />9.8 The Employer shall notify the Association in writing of each disciplinary action involving <br />suspension or discharge. <br />9.9 The Employer shall make every attempt to notify an Elssociation representative in the event of any <br />written discipline, suspeiision or discharge before the action is taken. <br />13 <br />
