If the <br />parties are unabie to agree in the amendment, they will be submitted to impasse procedures as <br />ouilined in Step 4 of the Grievance Procedure of ihe Collective Bargaining Agreement. <br />33.15 CONFLICT WITH 4THER LAWS <br />This Article is in no way intended to supersede or waive any constitutionat or otlter rigliis thai the <br />Employee may be entitled to under Federal, State or local statutes. <br />ARTICLE XXXIV <br />PROBATIONARY PERIOD <br />All new Employees shall have a probationary period of eighteen moirths. Probationarv period will <br />be extended until new Employee has earned Paramedic Certif'ication or thirty-six months, whichever comes <br />first. <br />During the probationarv period, discipline, suspension or discharge bv the Emp(oyer shail not be <br />subiect to the Grievance Procedure. <br />If an Emplovee is discharged or resigns during the protrationary period described 'ui the <br />aforementioned Secuon of this Article, and is later rehired, he shall be considered as a new Employee and <br />subject to a11 terms contained witlun [his Agreement. <br />ARTICLE XXXV <br />PERSONNEL RECORDS <br />35.1 The Employer shall maintain an individual official personnel file for each Employee. The official <br />personnel file shall be located in the office of the Fire Chief. Empioyees shall be permitted to <br />inspect dieir indiNidual persoruiel file during regular business hours (8:00 am. - 4:00 p.m.: <br />Monday tl?rough Friday, excluding Saturdays, Sundays and Hotidays) by giving reasonable notice <br />aitd request to inspect said individual personnel file to the Fire Chief. Should the Fire Chief not be <br />available at the requested tune, he shall schedule a time mutually agreeable between himself and <br />the Employee. During the inspection of the official file, the Employee may have one (1) <br />42 <br />
