? n <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2003 -182 <br />BY: Mayor Musial <br />AN ORDINANCE AUTHORIZING THE MAYOR, UPON THE REVIEW <br />AND APPROVAL OF THE BOARD OF CONTROL, TO ENTER INTO A <br />SOLE SOURCE AND DIRECT PURCHASE AGREEMENT WITH <br />HARRINGTON ELECTRIC COMPANY FOR THE ACQUISITION OF A 750 <br />%VA MINERAL FILLED TRANSFORMER FOR THE WASTEWATER <br />TREATMENT PLANT, WITHOUT PUBLIC BIDDING, AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, the Director of Public Service and the Superintendent of the <br />Wastewater Treatment Plant have enter into negotiations with Harrington Electric <br />Company, for the direct purchase of a 750 kva Mineral Filled Transformer, as a sole <br />source thereof, to be used at the Wastewater Treatment; and <br />WHEREAS, the City has been quoted a price of $26, 769.00 for the system, <br />completely assembled and delivered to the site at substantial cost savings by using the <br />existing concrete pad, etc.; and <br />WHEItEAS, the Director of Public Service and the Superintendent of the <br />Wastewater Treatment Plant have evaluated the direct purchase proposal and have <br />determined that the quotation submitted is a fair, reasonable and competitive offer for the <br />direct purchase of the assembly system from Harrington Electric Company as the "sole <br />source" of the products necessary, given the installation requirements, for the operation <br />of the Wastewater Treatment Plant; and <br />WHEREAS, it is the desire of this Council, upon the advice and recommendation <br />of the aforesaid Director and Superintendent, to authorize the Mayor, upon the approval <br />of the Board of Control, to enter into a direct purchase agreement with Harrington <br />Electric Company, exempting the contract from competitive bidding as an emergency; <br />and <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That this Council, upon the advise and recommendation of the <br />Director of Public Service and the Superintendent of the Wastewater Treatment Plant, <br />hereby finds and determines that the Harrington Electric Company quote is fair and <br />reasonable and, due to the emergency circumstances inherent in the direct purchase of <br />said equipment from this "sole source" supplier/contractor, further warrants an exception <br />from competitive bidding to enter this direct purchase agreement. <br />
