? City of North Royalton, Ohio wastewater treatment facilities and the City of North Olmsted, Ohio wastewater treatment facilities; and WHEREAS, the first Interim Agreement for continuing the stabilization of North 4lmsted Wastewater Treatment Plant Biosalids at the North Royalton Sludge Composting Facility expired on March 31, 2002; and WHEREAS, the second interim agreement for the stabilizing of North Olmsted Wastewater Treatment Plant Biosolids at the North Royalton Sludge Composting Facility expired on December 31, 2002: and WHEREAS, the third interim agreement for the stabilizing of North Olmsted Wastewater Treatment Plant Biosolids at the North Royalton Sludge Composting Facility expired on December 31, 2003: and WHEREAS, the Ohio Environmental Protection Agency will allow the City of North Olmsted, Ohio and the City of North Royalton, Ohio to continue the stabilizing of North Olmsted Wastewater Treatment Plant biosolids at the North Royalton Sludge Composting Facility on an interim basis while the Ohio Environmental Protection Agency completes it review of sludge managernent planning modifications prepared and submitted by both the City of North Olmsted, Ohio and the City of North Royalton, Ohio to the agency; and WHEREAS, the Board of Control of the City of North Olmsted, Ohio met on , 2004, as authorized by the Charter of the City of North Olmsted, Ohio and upon the recommendation of the Mayor, awarded this Fourth Interim Agreement with the City of North Royalton, Ohio, and WHEREAS, the City Council of North Royalton, authorized the Mayor of North Royalton ta enter into this Fourth Interim Agreement with the City of North Olmsted. NOW, THEREFORE, in consideration of the foregoing recital and the covenants and agreements of the parties herein set forth, the parties do agree as follows: SECTION I - TIME PERIOD A. The term of this Fourth Interim Agreement shall be January l, 2004 to and including December 31, 2004 or on the 90th calendar day following date of the approval of sludge management planning modifications prepared and submitted by both the City of North Olmsted, Ohio and the City of North Royalton, Ohio to the Ohio Environmental Protection Agency. B. The term of this Fourth Interim Agreement may be extended beyond December 31, 2004, for a definite period or periods of time, upon the mutual agreement of the City of North Royalton, Ohio and the City of North Olmsted, Ohio and a duly authorized modification of this agreement if the length of time required by the Ohio Environmental Protection Agency to review and approve modifications to the sludge management plans of each city exceeds the December 31, 2004 termination date of this Fourth Interim Agreement.
