CiTY OF NORTH OLMSTED RESOLUTION NO. 2003 -112 BY: Mayor Norman T. Musial A RESOLUTIONAUTHORIZING THE PAYMENT OF ONE THOUSAND ONE HUNDRED AND SIX DOLLARS AND FORTY CENTS ($1,106.40) TO THE FRATERIVAL ORDER OF POLICE, OHIO LABOR COUNCIL, INC. FOR DISTRIBUTION TO A SPECIFIC CORRECTIONS OFFICER OF THE UNION AND AS CONSIDERATION FOR THE SETTLEMENT OF A GRIEVANCE UNDER THE COI.LECTIVE BARGAINING AGREEMENT AND DECLARING AN EMERGENCY. N'HEREAS, the Fraternal Order of Police, Ohio Labor Council, Inc., had filed, on behalf of its membership in the Corrections Officers Unit of the North Olmsted Police Department, a grievance pursuant to the Collective Bargaining Agreement (CBA) challenging the Lay-off of one (1) jailer effective January 1, 2003, and the subsequent denial of this grievance has been gursued to arbitration; and WHEREAS, the Mayor and his designees have, on behalf of the Administration, received and negotiated terms for the settlemem of this grievance, prior to the commencement of arbitration, based on the payment of the amount of One Thousand, One Hundred and Six Dollars and Forty Cents ($1,106.40); and WHEREAS, the settlement terms include a stipulation that the Union's unilateral withdrawal of the grievance from arbitration would carry no precedential value and would remain subject to the ratification of this Council; and WHEREAS, the settlement terms are acceptable to the FOP, inasmuch as the affected Corrections Officer no longer desires reinstatement, the settlement amount is less than the potential backpay award, and the City and the Union can move forward with ongoing management and labor relations issues without arbitrating their respective positions in this particulax case; and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCII. OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That the Council does hereby ratify and agree to the settlement proposal negotiated by and on behalf of the City, the terms of which are contained in the settlement letter between the City and the FOP, a copy of which is attached and incorporated herein, and in lieu of any further or formal written agreement, this Council intends by these presents to accept the FOP's unilateral withdrawal of the identified grievance from arbitration and to authorize the payment of monetary consideration in full and flnal compromise and settlement thereof.
