<br />CiTY OF NORTH OLMSTED <br />RESOLUTION NO. 2003 -112 <br />BY: Mayor Norman T. Musial <br />A RESOLUTIONAUTHORIZING THE PAYMENT OF ONE THOUSAND <br />ONE HUNDRED AND SIX DOLLARS AND FORTY CENTS ($1,106.40) TO <br />THE FRATERIVAL ORDER OF POLICE, OHIO LABOR COUNCIL, INC. <br />FOR DISTRIBUTION TO A SPECIFIC CORRECTIONS OFFICER OF THE <br />UNION AND AS CONSIDERATION FOR THE SETTLEMENT OF A <br />GRIEVANCE UNDER THE COI.LECTIVE BARGAINING AGREEMENT <br />AND DECLARING AN EMERGENCY. <br />N'HEREAS, the Fraternal Order of Police, Ohio Labor Council, Inc., had filed, on behalf <br />of its membership in the Corrections Officers Unit of the North Olmsted Police Department, a <br />grievance pursuant to the Collective Bargaining Agreement (CBA) challenging the Lay-off of one <br />(1) jailer effective January 1, 2003, and the subsequent denial of this grievance has been gursued <br />to arbitration; and <br />WHEREAS, the Mayor and his designees have, on behalf of the Administration, received <br />and negotiated terms for the settlemem of this grievance, prior to the commencement of <br />arbitration, based on the payment of the amount of One Thousand, One Hundred and Six Dollars <br />and Forty Cents ($1,106.40); and <br />WHEREAS, the settlement terms include a stipulation that the Union's unilateral <br />withdrawal of the grievance from arbitration would carry no precedential value and would remain <br />subject to the ratification of this Council; and <br />WHEREAS, the settlement terms are acceptable to the FOP, inasmuch as the affected <br />Corrections Officer no longer desires reinstatement, the settlement amount is less than the <br />potential backpay award, and the City and the Union can move forward with ongoing <br />management and labor relations issues without arbitrating their respective positions in this <br />particulax case; and <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCII. OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Council does hereby ratify and agree to the settlement proposal <br />negotiated by and on behalf of the City, the terms of which are contained in the settlement letter <br />between the City and the FOP, a copy of which is attached and incorporated herein, and in lieu of <br />any further or formal written agreement, this Council intends by these presents to accept the <br />FOP's unilateral withdrawal of the identified grievance from arbitration and to authorize the <br />payment of monetary consideration in full and flnal compromise and settlement thereof. <br />
