Let me <br />restate, as I indicated by phone, that the City would be advised by counsel to <br />respond to your settlement proposal in this matter, in the interest of promoting <br />labor relations. I am, upon consultation with the City's administrative <br />officers, authorized to refuse your terms but to counter with a lesser proposal: <br />1. Any pre-arbitration settlement that we may reach is and remains subject to <br />the subsequent ratification of or contradiction by City Council, which would <br />remain as a condition of your unilateral withdrawal of the grievance and I would <br />stipulate to reinstatement should City Council refuse to compromise; <br />2. Unilateral withdrawal of the grievance would carry no precedential value; <br />3. The City would split the Arbitrator's fee pursuant to the terms of the CBA <br />(50/50) and would NOT pay the Union's share; <br />4. The City would NOT reimburse lost wages or benefits or tender any form of <br />backpay but would, purely as a compromise of this disputed claim, pay a sum of <br />One Thousand One Hundred and 5ix Dollars and forty cents. <br />If these terms are acceptable and I <br />your client, please contact me.
