<br />1 . <br />determ;n;r,c, Grantor's variance application in relation to area requirem,ents but exciusive of the <br />conditions herein. Grantee does not and cannot promise, g-ua.rantee or grant such a variance, by <br />and through this Easement, but the Crrantee can and does represent, as stated above, that it <br />recognizes and aclnowledges the location of the easement as a valid consideration for the BZA <br />in a variance application and proposal by Grantor to locate its build.ing. <br />The Crrantor hereby agrees to restrict the use of said premises within the limits of the <br />above described easement against the construction thereon or above or subjacent thereto any <br />buildings, structures, tunnels, or excavation therein in any manner interfering with said sewer <br />wha.tsoever, the access thereto, or the maintenance thereof, or otherwise interfering therewith; <br />provided that, notwithstanding the foregoin.g restrictions and prohibitions Grantor inay malce any <br />of the uses or do any of the things to the foregoing premises with the express written consent of <br />the Grantee. Such reserved and permitted usage shall include inter alia, landscaping, parking of <br />velucles within the regulations set forth in the Codified Ordinances, paving, streets, driveways, <br />sidewalks and the mai.n.tenance thereof, all within the regulations set forth in the North Olmsted <br />Codified Ordi.nances. <br />Grantor shall fu11y use and enjoy the aforesaid premises except as to the rights herein <br />granted; and Graiitee agrees to maintain the sewer Ii.ne, and keep hold and save the said Grantor <br />harmless for any and all damages arising from its use of the right, easement, and right-of-way <br />herein granted and agrees to maintain, repair and restore to its original condition, (except for <br />removal of necessary trees and shrubs) the premise located withui said right-of-way. <br />
