IVA. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2003 - 99 <br />BY: Mayor Musial <br />AN ORDINANCE DISPENSING WITH THE RFP PROCESS OTHERWISE <br />REQUIRED BY SECTIONS 111.03 ET SEQ. OF THE ADMINISTXATIVE <br />CODE AND AUTHORIZING THE MAYOR TO ENTER INTO A SECOND <br />AGREEMENT WITH FLOYD BROWNE ASSOCIATES, ING ("FBA") FOR <br />THE PURPOSE OF CREATING AN EXPANDED SANITARY SEWER <br />MA.STER PLAN FOR ADDITIONAL DEYELOPING AREAS WITHIN <br />OLMSTED TOWNSHIP, AND DECLARING AN EMERGENCY <br />WHEREAS, pursuant to the authorization previously granted by this Council in <br />Ordinance No. 2002-73, the Mayor entered into a contract with Floyd Browne Associates, Inc. <br />("FBA"), an engineer consulting firm, to prepare a sanitary sewer master plan for the Willow <br />Woods Subdivision in North Olmsted as well as for a portion of developing area in Olmsted <br />Township bordered by Cook Road on the North, Stearns Road on the East, Bronson Road on the <br />West and the Norfolk & Southern Railroad right of way on the South (the "Phase I study"); and <br />WHEREAS, FBA prepared the Phase I study to the satisfaction of the City; and <br />WHEREAS, pursuant to discussions had between the City, Cuyahoga County and <br />Olmsted Township, the City desires to prepare an expanded sanitary sewer master plan for <br />Olmsted Township to include completing Cook Road to the west of the Phase I study, Barton <br />Road north of Cook Road, Fitch Road south of Cook Road to the railroad tracks (including <br />portion of Cranage Road), Cook Road east of Fitch to the Olmsted Falls line (including Inland <br />Road), and Bagley Road from the Lorain County line to the Olmsted Falls Middle School <br />(including portions of Bronson, Jennings, and Stearns Roads); and <br />WHEREAS, the City Engineer has proposed that an RFP process to select a consulting <br />engineer to perform the project not be utilized and that FBA be selected to prepare the expanded <br />sanitary sewer master plan for the above-described Olmsted Township area ("Phase II Study"), <br />because of FBA's involvement in the City's original master plan and its recent satisfactory <br />completion of the Phase I study; and <br />WHEREA5, FBA has proposed to prepare the Phase II study for the price of Thirty <br />Seven Thousand Two Hundred Dollars ($37T200.00); and <br />WHEREAS, the City Engineer has determined that the said proposal by FBA is fair and <br />reasonable to the City; and <br />WHEREAS, it is the desire of this Council to dispense with the RFP process otherwise <br />required by Sections 111.03 et seq. of the Administration Code for the selection of a consulting <br />engineer to provide the said professional services, because FBA is the owner of the original <br />master plan for the Sewer District and recently completed the Phase I study in a satisfactory <br />fashion, and therefore is most qualified to prepare the Phase II study; and <br />WHEREAS, it is accordingly further the desire of this Council to authorize the Mayor to <br />enter into a contract with Floyd Brown Associates, Inc., on the basis of the proposal tendered;
