<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2003 - 95 <br />BY: Mayor Musial <br />A RESOLUTION AUTHORIZING THE MAYOR TO NOTIFY <br />BROWNING-FERRIS INDUSTRIES OF OHIO, ING ("BFI"), OF <br />THE CITY'S INTENTION TO TERMINATE ITS CONTRACT WITH <br />BFI IN ORDER TO PREVENT AN AUTOMATIC EXTENSION OF <br />THE CONTRACT; FURTHER AUTHORIZING THE MAYOR TO <br />SOLICIT BIDS FOR THE CITY'S CONTRACT FOR THE <br />COLLECTION AND DISPOSAL OF SOLID WASTE AND <br />PROCESSING OF RECYCLABLE MATERIALS; FURTHER <br />AUTHORIZING THE MAYOR, UPON APPROVAL OF THE BOARD <br />OF CONTROL, TO ENTER INTO A CONTRACT WITH THE <br />LOWEST AND BEST BIDDER; AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the current term of the City's contract with Browning-Ferris <br />Industries of Ohio, Inc. ("BFI") for the collection and disposal of solid waste and <br />processing of recyclable materials terminates on December 31, 2003; and <br />WHEREAS, the said contract provides for successive automatic renewals if the <br />City does not, within 120 days prior to the end of a term, notify the contractor of its intent <br />to terminate; and <br />WHEREAS, it is the recommendation of the Mayor that the City's contract for <br />the collection and disposal of solid waste and processing of recyclable materials, which <br />has not been competitively bid since 1996, be competitively bid this year in order to, if <br />possible, effect cost savings in the contract; and <br />WHEREAS, it is accordingly the desire of this Council to authorize the Mayor to <br />notify BFI of the City's intent to terminate its contract with BFI so as to prevent an <br />automatic extension of the contract; and <br />WHEREAS, it is further the desire of this Council to authorize the Mayor to <br />solicit bids for the City's contract for the collection and disposal of solid waste and <br />processing of recyclable materials and, following approval of the Board of Control, to <br />enter into a corrtract with the lowest and best bidder; <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />
