<br />SECTION 1: That the Mayor be and he is hereby authorized to notify Browning <br />Ferris Industries of Ohio, Inc., and/or its successor in interest, if any ("BFI"), of the <br />City's intent to terminate its cunent contract with BFI so as to prevent an automatic <br />extensiQn af the said contract. <br />SECTION 2: That the Mayor be and he is hereby authorized to advertise for bids <br />for the City's contract for the collection and disposal of solid waste and processing of <br />recyclable materials in accordance with specifications now on file in his office, and <br />further that, upon approval by the Board of Control, the Mayor is hereby further <br />authorized to enter into a contract and execute the same on behalf of the City of North <br />Olmsted with the lowest and best bidder. <br />SECTION 3: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare and <br />for the further reason that it is necessary that this legislation go into efFect immediately so <br />that the Mayor may timely act to notify BFI and avoid an automatic extension of the <br />City's contract with BFI, and further so that the City may timely enter into a new contract <br />without any gap in providing this vital service to its residents, and further provided it <br />receives the affirmative vote of two-thirds of all members of Council, it shall take effect <br />and be in force immediately upon its passage and approval by the Mayor. <br />PASSED: ,_e.,, o? f? 0 3 <br />i" <br />ATTESK <br />ARA L.
