<br /> <br />Ordinance No. 2003-93 <br />dollars ($100.00) to guarantee the cost of cleaning the premises and removing any property <br />therefram after the termination of the busirress. If the premises on which such busimess is <br />conducted are not cleaned and all merchandise, property and refuse are not removed therefrom <br />and properly disposed of within forty-eight hours after the termination of the business, the <br />Director of Public Safety sha11 immediately cause such work to be done and report the cost <br />thereofto the Birector ofFinance, who shatt deduct such cost and return any batance of tiie <br />deposit. The licensee shall be liable for any deficiency. <br />Sha11 be amended and, as amended, sha11 read as follows: <br />721.06 DEPOSIT FOR CLEANING PREMISES. <br />The applicant sha11 also deposit, before such license is issued, the sum of Two hundred <br />dollars ($200.00) to guarantee the cost of cleaning the premises and removing any property <br />therefrom after the termination of the business. Any and all elements of the temporary business <br />or promotional event which are placed on the premises, sidewalk or parking area shall be <br />maintained in a state of cleanliness and good repair, and shall not cause, create or suffer to <br />ezist conditions of trash, litter, debris, noise, glare, dust, or ot6er nuisance. Responsibility <br />for such maintenance shall rest with the licensee. If the premises on which such business is <br />conducted are not cleaned and all merchandise, property and refuse are not removed therefrom <br />and properly disposed of within forty-eight hours after the termination of the business or licensed <br />event, the Director of Public Safety sha11 immediately notify the licensee in writing and, absent <br />compliance within five (5) business days, shall cause such work to be done. Any costs <br />incurred shall be reported to the Director of Finance and imposed against said deposit and <br />the balance of the deposit refunded. The licensee sha11 be liable for any deficiency. <br />SECTION 4: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare and for the <br />further reason that it is immediately necessary to regulate the outdoor display and sale of <br />merchandise from parking areas, tents and upon sidewalks of commercial premises in the City of <br />North Olmsted in order to eliminate health hazards effecting and prevent injury to residents in this <br />community, and further provided that it receives the affirmative vote of two-thirds of a11 members <br />of Council, it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor. <br />6 <br />
