?4X 4•? <br />MEMORANDUM OF UNDERSTANDING NO. 1 <br />This Memorandum of Understanding No. 1 is made this day of <br />2003, between the North Olmsted Fire Fighters, International <br />Association of Fire Fighters No. 1(IAFF) Local 1267 (hereinafter jointly referred to as <br />"Association") and the City of North Olmsted (hereinafter referred to as the "City"). The <br />Association and the City hereby acknowledge the following: <br />1. The Association is recognized by the City as the sole and exclusive bargaining <br />unit representative of the employees of the City Fire Department who are members of the <br />Association. <br />2. The parties are signatories to a Collective Bargaining Agreement (CBA) dated <br />January 1, 2002 through December 31, 2003, Article XX of which authorizes amendment <br />by mutual agreement, subject to the terms of said CBA. <br />3. Pursuant to and in accordance with Article VII, Section 7.3, Step 4(D), the <br />parties have entered into and this Memorandum of Understanding No. 1 is part of a final, <br />binding and conclusive pre-arbitration grievance settlement, to-wit: to amend the CBA to <br />provide for orthodontic coverage within the dental plan. <br />4. Therefore, the parties hereby agree to amend Article XIX, Health Benefits, <br />Section 19.4, which presently reads as follows: <br />1 <br />
