<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2003-50 <br />BY: Council Member Kasler <br />AN ORDINANCE CREATING SECTION 161.13 OF THE ADMINISTRATIVE <br />CODE, ENTITLED "HOURS OF WORK, OVERTIME COMPENSATION AND <br />COMFENSATORY TIME OFF" PROVIDING THAT CITY DIREC?'ORS SHALL <br />NOT BE ENTITLED TO RECEIVE EITHER OVERTIME COMPENSATION OR <br />COMPENSATORY TIME OFF ("COMP TIME") IN CONNECTION WITH THEIR <br />CITY EMPLOYMENT, AND DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, the City's appointed Directors are salaried officials who are not entitled, <br />under either the Fair Labor Standards Act ("FLSA") or this City's Salary Range Ordinance, to <br />receive overtime compensation for hours worked in excess of forty (40) hours per week; and <br />WHEREAS, it is the desire of this Council to prohibit the Mayor from permitting <br />Directors to accumulate and use compensatory time off ("comp time") when Directors work in <br />excess of forty (40) hours per week; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That there be and hereby is created new Section 161.13 of the <br />Administrative Code of the City of North Olmsted, entitled "Hours of Work, Overtime <br />Compensation and Compensatory Time Off," which shall read in its entirety as follows: <br />161.13 HOURS OF WORK, OVERTIME COMPEN5ATION, AND <br />COMPENSATORY TIME OFF. <br />(A) Definitions. For purposes of this Section, "Director" shall mean the Director of <br />Public Service, the Director of Public Safety, the Director of Personnel and Administrative <br />Services, the Director of Human Resources, the Director of Planning, and any other appointed <br />Director who heads a Department created by the Charter or City Council. <br />(B) Provisions for Directors. Directors shall work at least forty hours per week, and, in <br />addition, shall attend evening and weekend meetings, as directed by the Mayor or as required by <br />Council. Directors shall not be entitled to either overtime compensation or compensatory time <br />off ("comp time") for hours worked in excess of forty (40) hours per week. <br />
