A <br />P e ?? <br />May 16, 2003 <br />To: All of Council <br />From: Mayor Musial <br />Subject: Ordinance No. 2003-50 - AN ORDINANCE CREATING SECTION <br />161.13 OF THE ADMI1vISTRATIVE CODE, ENTITLED "HOURS OF <br />WORK, OVERTIME COMPENSATION AND COMPENSATORY <br />TIME OFF" PROVIDING THAT CITY DIRECTORS SHALL NOT BE <br />ENTITLED TO RECEIVE EITHER OVERTIME COMPENSATION OR <br />COMPENSATORY TIME OFF ("COMI' TIME') 1N CONNECTION <br />WITH THEIR CITY EMPLOYMENT, AND DECLARING AN <br />EMERGENCY, AS AMENDED. <br />I hereby place my veto on 2003-50 <br />The current Ord. 2003-50 (sponsored by Councilperson Kasler) appears to be a makeover <br />amendment over the Ord. 2003-50 (sponsored by Councilpersons Kasler, Miller and <br />Gazeau) which was introduced at the Council meeting of March 18, 2003. The makeover <br />amendment is the result of a finance committee meeting held on Apri130, 2003 and was <br />reviewed at a finance comm. meeting, which was scheduled at 7:15 p.m. just before the <br />Council meeting of May 7, 2003. The makeover amendment was passed under <br />suspension of the rules on May 7, 2003. This Legislation creates new Section 161.13 of <br />the Administrative Code, in essence, ... "providing that City Directors sha.ll not be <br />entitled to receive overtime compensation of compensatory tinne off ("Comp Time") in <br />connection with their City employment". <br />Although the Fair labor Standatds Act (FLSA) does not entitle City's appointed Directors <br />to receive overtime compensation for hours worked over foriy hours per week, the Act <br />doesn't prohibit the granting of Comp Time. <br />It is to be noted that compensatory time policies have been in existence in North Olmsted <br />for over twenty yeazs involving City employees, including at least one Director. By <br />eliminating comp time totally, Ord. 2003-50 as passed not only changes an established <br />practice and reduces flexibility, but also is extremely draconian in nature and particularly <br />imposes great hardship on first year Directors. <br />First year Directors don't have personal leave time available to them during their first <br />yeaz of service in the form of vacation time (a two-week period is available after a yeaz of <br />
