Authorize the Planning Commission to require the developer to <br />present, at its expense, reports and recommendations of expert <br />planning <br />WHEREAS, the Planning Commission on the ? day of <br />2003, by formal motion, recommended that this Ordinance, proposing to amend Chapter <br />1126 of the Planning and Zoning Code of the City of North Olmsted by changing the <br />requirements for commercial building permits by requiring additional fees and adopting <br />other new procedures (approved)(disapproved); and <br />WHEREAS, following publication of newspaper notice, a public hearing was <br />held in conformance with the provisions of 5ection 14 of icle IV of the Charter and <br />Section 1127.03 of the Zoning Code, on the ?9 day of /' 2003. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE <br />CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />Section 1: That Sections 1126.02, 1126.03 and 1126.04 of Chapter 1126 of <br />the Zoning Code (Planning and Zoning Code) which presently read as follows: <br />1126,02 DRAWINGS, ETC. TO ACCOMPANY APPLICATION. <br />Application for building permits required under Section 1126.01 shall be <br />accompanied by such drawings, sketches, plans, including landscaping plans, <br />renderings, photographs, material samples, and other items as shall be reasonably <br />required by rule of the Building Oi?'icial in order to determine the proposal's <br />compliance with the zoning and all other applicable codes of the City. All <br />applications shall further be accompanied by a nonrefundable fee as per the <br />schedule of fees adopted by Council. (Ord. 90-125. Passed 5-21-91.) <br />1126.03 REFERRAL OF APPLICATION TO PLANNING COMIIUSSION. <br />All applications for building permits required by this chapter shall be reviewed by <br />the Building Official and, if the proposal meets all requirements of the zoning and <br />all other applicable codes of the city, it shall be referred to the Planning <br />Commission for the Commission's review at the Commission's next first monthly <br />meeting following the tenth day after receipt of the application; provided, <br />however, that the Building Official may refer the proposal to a succeeding first <br />monthly meeting if the Commission's agenda for the next first monthly meeting <br />is, in the opinion of the Building Official, too full to accommodate a full and fair <br />review of the proposal. In the event an application contains a proposal which is <br />violative of the zoning or another applicable code of the City, or the application is <br />not accompanied by all drawings and other documents or materials required by <br />Section 1126.02 or by rule of the Building Official, it shall be rejected by the <br />Building Official, who shall notify the applicant of the reasons for the rejection; <br />provided, however, that if the application contains a proposal which requests a <br />variance or variances from the applicability of any provision of the Zoning Code <br />of the City, but in all other respects complies with the zoning and all other <br />
