Authorize the Planning Commission to require the developer to present, at its expense, reports and recommendations of expert planning WHEREAS, the Planning Commission on the ? day of 2003, by formal motion, recommended that this Ordinance, proposing to amend Chapter 1126 of the Planning and Zoning Code of the City of North Olmsted by changing the requirements for commercial building permits by requiring additional fees and adopting other new procedures (approved)(disapproved); and WHEREAS, following publication of newspaper notice, a public hearing was held in conformance with the provisions of 5ection 14 of icle IV of the Charter and Section 1127.03 of the Zoning Code, on the ?9 day of /' 2003. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: Section 1: That Sections 1126.02, 1126.03 and 1126.04 of Chapter 1126 of the Zoning Code (Planning and Zoning Code) which presently read as follows: 1126,02 DRAWINGS, ETC. TO ACCOMPANY APPLICATION. Application for building permits required under Section 1126.01 shall be accompanied by such drawings, sketches, plans, including landscaping plans, renderings, photographs, material samples, and other items as shall be reasonably required by rule of the Building Oi?'icial in order to determine the proposal's compliance with the zoning and all other applicable codes of the City. All applications shall further be accompanied by a nonrefundable fee as per the schedule of fees adopted by Council. (Ord. 90-125. Passed 5-21-91.) 1126.03 REFERRAL OF APPLICATION TO PLANNING COMIIUSSION. All applications for building permits required by this chapter shall be reviewed by the Building Official and, if the proposal meets all requirements of the zoning and all other applicable codes of the city, it shall be referred to the Planning Commission for the Commission's review at the Commission's next first monthly meeting following the tenth day after receipt of the application; provided, however, that the Building Official may refer the proposal to a succeeding first monthly meeting if the Commission's agenda for the next first monthly meeting is, in the opinion of the Building Official, too full to accommodate a full and fair review of the proposal. In the event an application contains a proposal which is violative of the zoning or another applicable code of the City, or the application is not accompanied by all drawings and other documents or materials required by Section 1126.02 or by rule of the Building Official, it shall be rejected by the Building Official, who shall notify the applicant of the reasons for the rejection; provided, however, that if the application contains a proposal which requests a variance or variances from the applicability of any provision of the Zoning Code of the City, but in all other respects complies with the zoning and all other
