<br />Ordinance No. 200347 <br />Page 5 <br /> <br />Section 1126.03 REVIEW BY BUILDING OFFICIAL; REFERRAL <br />TO ARCHITECTURAL REVIEW BOARD <br />(a) All applications for building permits required by this chapter shall be <br />reviewed by the Building Official and, if the proposal meets all requirements of the <br />zoning and a11 other applicable codes of the City, it shall be referred initially to the <br />Architectural Review Board for its recommendations, at its next regularly scheduled <br />meeting, and then to the Planning Commission for the Commission's review. <br />(b)In the event an application contains a proposal which is violative of the zoning <br />or another applicable code of the City, or the application is not accompanied by all <br />drawings and other documents or materials required by Section 1126.02 or by rule of the <br />Building Official, and, if applicable, by rule of the Planning Commission, it shall be <br />rejected by the Building Official, who shall natify the applicant of the reasons for the <br />rejection_ <br />(c) In the event that the application contains a proposal which requests a variance <br />or variances from the applicability of any provision of the Zoning Code of the City, but in <br />all other respects complies with the zoning and all other applicable codes of the City, and <br />is accompanied by all drawings and other documents and materials required by Section <br />1126.02 and by the rules of the Building Official, and, if applicable, by rule of the <br />Planning Commission, it shall be first referred to the Architectural Review Board for its <br />recommendations, at its next regularly scheduled meeting, and then to the Planning <br />Commission for its recommendations on the variance request prior to referral to the <br />Board of Zoning Appeals. <br />(d) The Building Official may request, in the interest of expediting the review <br />process and in anticipation of a Planning Commission requirement thereof, the comment <br />or report of any appropriate City official or department and shall, in the event that <br />development proceeds under subsection (c), provide a report and recommendation to the <br />Planning Commission and the Board of Zoning Appeals on the variances requested. <br />SECTION 4: That there be and hereby is created an amended Section <br />1126.04(d) of Chapter 1126 of the Planning and Zoning Code of the City of North <br />Olmsted, which subsection is presently entitled "Public Iuut; Advice of Other Officials <br />and Bodies." Said amended Subsection 1126.04(d) shall be retitled and provided in form <br />and substance as set forth below, which displays and differentiates between the existing <br />and proposed regulations, and which shall henceforth read upon adoption as follows: <br />1126.04 REVIEW BY PLANNING COMIVIISSION. <br />(a) Scope of Review. All applications for building permits which aze properly <br />referred to the Planning Commission shall be reviewed by the Commission for the <br />purpose of making the following determinations only: <br />(1) Whether the proposal will have any significant adverse impact on <br />residential, commercial or other neighbors whose properties abut the <br />property of the applicant; and <br />(2) Whether the proposal will have any significant adverse impact on <br />vehicular or pedestrian safety on the applicant's property, on the property <br />of abutting owners, or within the adjoining right-of-way area; and
