<br />pedestrian safety, it affects the public health, safety or welfare, or, with
<br />respect to the aesthetics of the proposal, it will have a probable negative
<br />effect upon the market value of properties surrounding it within the same
<br />zoning district.
<br />(c) Authority of Commission to Change Proposal. If the Planning Commission
<br />determines that a proposal will have a significant adverse impact upon either residential,
<br />commercial or other neighbors, vehicular or pedestrian safety, or aesthetically upon the
<br />community, it shall make such changes, and only such changes, in the proposal which
<br />will, if practicable, eliminate the significant adverse impact, and, if such a change is not
<br />practicable, then such changes which will ameliorate the adverse impact to the fullest
<br />exrtent practicable.
<br />(d) Public Input: Advice of Other Officials and Bodies. In making its determinations and
<br />proposed changes pursuant to this section, the Planning Commission shall receive
<br />complaints, comments and recommendations from the public. Prior to making its
<br />determinations and proposed changes, the Commission may refer the proposal to the
<br />Architectural Review Board, the Forester, the Safety Departments, and any other City
<br />officials, board, or commission, whose advice and recommendation may, in the opinion
<br />of the Commission, assist the Commission in fulfilling its duties herein.
<br />(e) Time for Review. The Planning Commission shall, within sixty days of its first review
<br />of a proposal, make its determinations and changes, if any are required, unless this period
<br />of time is extended, either with the consent of the applicant or because of delay
<br />attributable to the applicant. (Ord. 90-125. Passed 5-21-91.)
<br />SECTION 2: That there be and hereby is created an amended Section 1126.02 of
<br />Chapter 1126 of the Planning and Zoning Code of the City of North Olmsted, which is
<br />presently entitled "DRAWINGS, ETC. TO ACCOMPANY APPLICATIONS." Said
<br />amended Section 1126.02 shall be and is hereby amended to provide in form and
<br />substance as set forth below, which displays and differentiates between the existing and
<br />proposed regulations, and which shall henceforth read upon adoption as follows:
<br />1126.02 DRAWINGS, ETC. TO ACCOMPANY APPLICATIONS.
<br />Application for building permits required under Section 1126.01 shall
<br />be accompanied by such drawings, sketches, plans, including landscaping plans,
<br />renderings, photographs, material samples, and other items as shall reasonably by rule of
<br />the Building Official, and, if applicable, by rule of the Planning Commission, in order to
<br />determine the proposal's compliance with the zoning and all other applicable codes of the
<br />City. All applications shall further be accompanied by a nonrefundable fee as per the
<br />schedule of fees adopted by Council.
<br />SECTION 3: That there be and hereby is created an amended Section 1126.03 of
<br />Chapter 1126 of the Planning and Zoning Code of the City of North Olmsted, which is
<br />presently entitled "REFERRAL OF APPLICATION TO PLANNING COMNIISSION."
<br />Said amended Section 1126.03 shall be retitled and provide in form and substance as set
<br />forth below, which displays and differentiates between existing and proposed regulations,
<br />and which shall henceforth read upon adoption as follows:
