-- 3 AGREEMENT M1?? THIS AGREEMENT, made and entered into this day of 12003, Sy and between the City of North Oimsted, Ohio (hereinafter referred to as "City") and N.E. De! Giudice Architects, Inc., 21380 Lorain Road, Fairview Park, Ohio 44126 (hereinafter referred to as the `Architect"). WITNESSETH THAT WHEREAS, The Ohio Building Code (OBC) requires that the City engage the services of a Class II Plans Examiner in order to perfiorm a governmental function as defined under ORC 2744.01 (C)(1)(p); and WHEREAS, the Architect is duly certified by the State of Ohio as a Class II Plans Examiner; NOW THEREFORE, in consideration of mutual promises, covenants, and agreements herein contained, the parties do hereby agree as follows: TERMS This agreement shall be for six (6) months commencing on the date of the agreement, and may be terminated by either party giving thirty (30) days written notice to the other party. SERVICES/SCOPE OF THE WORK Basic Services: The Architect shall act as Back-up Class II Plans Examiner. When acting in the capacity of a C{ass II Plans Examiner, the Architeet shall perform plan reviews as defined by OBC 105.3.1.1 and 105.3.1.3. To the extent reasonably necessary to enable the Architect to perform the duties hereunder, the Architect shall be authorized to engage the services or retain any other person(s) or corporation(s) necessary to aid or assist in the proper performance of the duties. Additional Services At the request of the City, Building Official, or representative, the Architect shall, upon reasonable notice: Meet with the Building Official or City representative and shall, with him or alone as instructed, visit construction sites under jurisdictional authority of the City and make whatever inspection reports, written or oral, that may be deemed necessary at the time.
