CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2003 - 33 <br />BY: Council Members Kasler, Miller, Gareau and Nashar. <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO <br />THE ELECTORS OF THE CITY OF NORTH OLMSTED OF <br />AN AMENDMENT TO ARTICLE lil, SECTION S(a) OF THE <br />CHARTER OF THE CITY OF NORTH OLMSTED TO <br />REQUIRE THAT MAYORAL APPOINTMENTS OF <br />DIRECTORS BE SUBJECT TO THE CONSENT AND <br />APPROVAL OF THE MEMBERS OF THE COUNCIL, AND <br />DECLARING AN EMERGENCY, AS AMENDED. <br />BE IT ORDAINED by the Council of the City of North Olmsted, County of <br />Cuyahoga, Ohio, two-thirds of all members concuning that: <br />SECTION 1: Pursuant to Article XVIII, Section 9 of the Ohio Constitution, and Article <br />XII of the Charter of the City of North Olmsted, this Council authorizes and directs that the <br />following proposal to amend the Charter of the City of North Olmsted be submitted to the <br />electors of the City of North Olmsted at an election to be held at the usual places of voting in the <br />City on Tuesday, November 4, 2003: <br />That Article III, Section 5(a) of the Charter be amended by requiring that M:ayoral <br />appointments of Directors be subject to the consent and approval of the members of the City <br />Council, so that, as amended, the said paragraph (a) of Section 5 shall read as follows: <br />Article III <br />THE MAYOR <br />SEC. 5 DUTIES AND POWERS OF THE MAYOR. <br />(a) Executive Powers. The Mayor shall be the chief executive officer of the City. He sha11 <br />supervise the administration of the City's affairs and shall exercise control over all departments <br />and divisions. He shall be the chief conservator of the peace within the City and shall cause all <br />laws and ordinances to be enforced. He sha11 be responsible for the preparation and submission <br />of the annual estimate of receipts and expenditures, and of appropriation measures, and shall at <br />all times keep the Council fully advised as to the financial condition and needs of the City. He <br />shall cause all terms and conditions imposed in favor of the City or its inhabitants in any <br />franchise or contract to which the City is a party to be faithfully kept and performed. <br />Except as may otherwise be provided by this Charter or the laws of the State of Ohio <br />governing Civil Service, the Mayor shall have the power to appoint, promote, transfer, reduce or <br />remove any officer or employee of the City except (a), those required by this Charter to be <br />??.u . _.. . ., _
