<br />Urdinance No. 2003-33 <br />elected, and (b), those whose terms of office may be fixed by this Charter. Each mayoral <br />appointment of the head of a department shall be subject to the consent and approval of Council, <br />which may disapprove such an appointment only by a vote of not less than two-thirds vote of its <br />members. The appointment of every officer and employee appointed by the Mayor shall, unless <br />otherwise provided in this Charter, automatically terminate at the earlier of (1) the end of the <br />term of office of the Mayor making the appointment, or (2) the date upon which the Mayor <br />making the appointment leaves office by death, resignation or other reason creating a vacancy in <br />the office of Mayor. Unless otherwise provided for in this Charter, the Mayor may during his <br />term, without concurrence of Council, remove any officer or employee whom he has appointed <br />provided, however, that heads of departments or divisions created by this Charter may only be <br />removed with the concunence of two-thirds (2/3) of the members of Council eligible to vote. <br />The Mayor shall execute on behalf of the City, all contracts, conveyances, evidences of <br />indebtedness, and all other instruments to which the City is a party. He shall have custody of the <br />seal of the City and may affix it to a11 of said instruments, but the absence of the seal shall not <br />affect the validity of any such instrument. The Mayor shall be recognized as the ofFicial and <br />ceremonial head of the City government by the Governor for military purposes and by the courts <br />for the purpose of serving civil processes. <br />SECTION 2: If the foregoing proposal receives the affirmative vote of a majority of the <br />electors voting thereon, then the said amendment to Article III, Section 5(a) of the Charter shall <br />be effective as of the earliest date provided by law. <br />SECTION 3: It is the desire of the Council that the ballot for said question shall be in <br />substantially the following form: <br />PROPOSED CHARTER AMENDMENT <br />A majority affirmative vote is necessary for passage. <br />Shall Article III, Section 5(a) of the City Charter be amended so as <br />to require that all mayoral appointments of Directors of City <br />Departments be subject to the consent and approval of the <br />members of City Council? <br />0 Yes <br />F.] No <br />2 <br />
