15.3 To maintain any benefits normally paid by the Employer, the Employee on leave as in Article 15.1 <br />or 15.2 shall pay the eost of such benefits to the Finance Director on the first day of the month for <br />which the benefit payment applies. <br />15.4 If an Employee does not report to the Fire Chief upon expiration of the leave of absence, he shall <br />lose all rights of employment. <br />15.5 Probationary Employees shall not be eligible for a Leave of Absence. <br />ARTICLE XVI <br />WORK RELATED ILLNESS/IlNJURY <br />16.1 The parties hereto recognize and agree that the duties of the Employee of the Division of Fire are <br />such that said Employees are exposed to disease and injury as a result of their assigned duties. It <br />is the intenrion of the parties to provide to said Employees, salary continuation benefits when an <br />Employee contracts an illness as hereinafter specified. Likewise, it is the intention of the parties to <br />provide to said Employee, salary continuation benefits when an Employee is injured while <br />responding to an emergency call, retuming from an emergency call, operating at or during an <br />emergency call or training that replicates emergency situations. It is not intended that salary <br />cantinuation benefits be granted to employees who incur routine injuries in the performance of <br />their duries in non-emergency situations. <br />16.1(a) In the event that a full time swom Employee of The North Olmsted Fire Department <br />should become ill due to contact with AIDS, Hepatitis, Tuberculosis, or Meningitis, and such <br />illness has so incapacitated the Employee that he temporarily is unable to work, the Fire Chief <br />shall investigate and determine whether the illness is work related and of a temporary nature. The <br />Fire Chief shall then forward his finding to the Safety Director who shall determine the nature and <br />extent of the illness and how contracted, including the circumstances thereof. If after <br />consideration of the totality of the facts, the Safety Director determines that said disease was <br />contracted during employment and is of a temporary nature requiring medical leave, the Safety <br />Director may authorize the full payment of the employees regular salary for a period of ninety <br />days. <br />16.1(b) If an Employee is injured while engaged in an emergency response, an injury <br />28 <br />, <br />: <br />.,. „ . . .. ? , F•'Y`3.? . ? . . ... , .
