? <br />? <br />Resolution No. 2003-29 <br />Page 2 <br />SECTION l: That this Council recognizes that ihe City of North Olmsted is bound by and <br />subject to a Water Service Agreement with the City of Cleveland, as approved by Ordinance No. <br />1983-49, and does not intend by this Resolution to initiate any action in breach or termination <br />thereof; <br />SECTIUN 2: That this Council hereby recognizes that the City of North Olmsted has <br />recentty passed Ordinance No. 2003-04, authorizing the Mayor, on behalf of the City, to become <br />a member of a Council of Governments, initiated by the Cuyahoga County Mayors and <br />Managers Associatioq for the purpose of negotiating new water rates under the current Water <br />Service Agreement with the City of Cleveland, and does not intend by this Resolution, or any <br />actions taken in furtherance of this Resolution, to initiate any action in breach or termination <br />thereof. <br />SE , TION 3: That this Cvuncil hereby authorizes and directs the Mayor to commission a <br />feasibility study to determine the benefits of and impediments to entering into a new water <br />services agreement with a public water system in Lorain County, in order to acquire water at a <br />better rate for North Olmsted residents and property owriers, and further authorizes and directs <br />the Mayor to report to the Intra-Governmental Relations Committee of Council, on a regular <br />basis, regarding the status of his efforts to determine the feasibility of entering into such a new <br />agreement with another public water system, and ascertain the existence of any legal or other <br />impediments to entering into such a new agreement, in order to satisfy resident inquiries <br />concerning such possible altemative water supply sources. <br />SEC7'ION 4: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, sa.fety and welfaze, and for the <br />reason that it is necessary that this Resotution go into effect immediately due to recent initiatives <br />and imminent negotiations regarding water supply to the City, and further provided it receives <br />the affirmative vote of two-thirds of all members of this Council, it shall take effect and be in <br />PASSED: ;/%?.?- ? ?'? a DO 3 First Reading.• A-, 3 <br />?
