I" CITY OF NORTH OLMSTED ORDINANCE NO. 2003 - 17 BY: Council Member Gareau AN ORDINANCE AMENDING SECTION 16702 OF THE ADMINISTRATIVE CODE, ENTITLED "DIRECTOR, " AND CREATING NEW SECTION 17Z 02 OF THE ADMINISTRATIVE CODE, ENITLED "REMOYAL OF DIRECTOR," SO AS TO PROVIDE THAT THE DIRECTOR OF PERSONNEL AND ADMINISTRATIVE SERVICES AND THE DIRECTOR OF PLANNING, LIgE ALL OTHER DIRECTORS APPOINTED BY THE MAYOR, MAY BE REMOVED ONLY WITH THE CONCURRENCE OF TWO-THIRDS (213) OF THE MEMBERS OF COUNCIL ELIGIBLE TO VOTE, AND DECLARING AN EMERGENCY. WHEREAS, pursuant to Article III, Section 5 of the Charter, the Mayor may only remove appointed Directors, whose offices are created by Charter, with the concurrence of two- third (2/3) of the members of Council eligible to vote; and WHEREAS, the offices of Director of Personnel and Administrative Services and Director of Planning were created by ordinance, and not by Charter; and N'HEREAS, wherefore, it is the desire of this Council to bring parity to a11 appointed Director level positions by providing that the Director of Personnel and Administrative Services, and the Director of Planning, may only bs removed by the concurrence of two-third (2/3) of the members of Council eligible to vote; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That Section 167.02 of the Administrative Code of the City of North Olmsted, entitled "Director," which presently reads as follows: "167A2 DIRECTOR The Department of Personnel and Administrative Services shall be headed by a Director who shall be answerable to the Mayor." Be amended, and, as amended, shall read in its entirety as follows: "167.02 DIItECTOR The Department of Personnel and Administrative Services shall be headed by a Director who shall be answerable to the Mayor.
