I" <br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2003 - 17 <br />BY: Council Member Gareau <br />AN ORDINANCE AMENDING SECTION 16702 OF THE ADMINISTRATIVE <br />CODE, ENTITLED "DIRECTOR, " AND CREATING NEW SECTION 17Z 02 OF <br />THE ADMINISTRATIVE CODE, ENITLED "REMOYAL OF DIRECTOR," SO AS <br />TO PROVIDE THAT THE DIRECTOR OF PERSONNEL AND ADMINISTRATIVE <br />SERVICES AND THE DIRECTOR OF PLANNING, LIgE ALL OTHER <br />DIRECTORS APPOINTED BY THE MAYOR, MAY BE REMOVED ONLY WITH <br />THE CONCURRENCE OF TWO-THIRDS (213) OF THE MEMBERS OF COUNCIL <br />ELIGIBLE TO VOTE, AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to Article III, Section 5 of the Charter, the Mayor may only <br />remove appointed Directors, whose offices are created by Charter, with the concurrence of two- <br />third (2/3) of the members of Council eligible to vote; and <br />WHEREAS, the offices of Director of Personnel and Administrative Services and <br />Director of Planning were created by ordinance, and not by Charter; and <br />N'HEREAS, wherefore, it is the desire of this Council to bring parity to a11 appointed <br />Director level positions by providing that the Director of Personnel and Administrative Services, <br />and the Director of Planning, may only bs removed by the concurrence of two-third (2/3) of the <br />members of Council eligible to vote; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 167.02 of the Administrative Code of the City of North <br />Olmsted, entitled "Director," which presently reads as follows: <br />"167A2 DIRECTOR <br />The Department of Personnel and Administrative Services shall be headed by a Director <br />who shall be answerable to the Mayor." <br />Be amended, and, as amended, shall read in its entirety as follows: <br />"167.02 DIItECTOR <br />The Department of Personnel and Administrative Services shall be headed by a Director <br />who shall be answerable to the Mayor.
