SECTION 4 CITY'S RESPONSIBILITIES. The CITY shall do the following in a timely manner: 4.1 Designate a CITY representative having the authority to give instructions, receive information, inspect, define the CITY'S policies and make decisions with respect to the PROJECT. 4.2 Provide all criteria and information as to the CITY' S requirements for the PROJECT, including design objectives and constraints and budgetary limitations. 4.3 Furnish copies of all design and construction standards, which the CITY will require to be included in the PROJECT. 4.4 Provide all available data and information in the possession of the CITY relevant to the design and construction of the PROJECT. This data and information includes a property survey and boundary information; property descriptions, zoning, deed and other land use restrictions; and other necessary data and consuhations as may be required. This data and information was prepared by other professionals and wilJ. be available upon request by the CONTRACTOR. 4.5 Give prompt written notice to the CONTRACTOR whenever the CITY observes or otherwise becomes aware of any event that affects the Section 1. Basic Work of the Contractor or the Section 2. Additional Work of the Contractor. SECTION 5. TIME SCHEDULE 5.1 Unless otherwise directed by the CITY, the CONTRACTOR shall commence the performance of the Section l. Basic Work of the Contractor upon execution of this Agreement and upon receiving approval of CITY's Construction Manager. 5.2 The CONTRACTOR recognizes that time is of the essence in the performance of the services required under this Agreement and that services are to be performed as expeditiously as practical.
