<br />SECTION 4 CITY'S RESPONSIBILITIES. The CITY shall do the following in a <br />timely manner: <br />4.1 Designate a CITY representative having the authority to give instructions, <br />receive information, inspect, define the CITY'S policies and make decisions with respect <br />to the PROJECT. <br />4.2 Provide all criteria and information as to the CITY' S requirements for the <br />PROJECT, including design objectives and constraints and budgetary limitations. <br />4.3 Furnish copies of all design and construction standards, which the CITY <br />will require to be included in the PROJECT. <br />4.4 Provide all available data and information in the possession of the CITY <br />relevant to the design and construction of the PROJECT. This data and information <br />includes a property survey and boundary information; property descriptions, zoning, deed <br />and other land use restrictions; and other necessary data and consuhations as may be <br />required. This data and information was prepared by other professionals and wilJ. be <br />available upon request by the CONTRACTOR. <br />4.5 Give prompt written notice to the CONTRACTOR whenever the CITY <br />observes or otherwise becomes aware of any event that affects the Section 1. Basic Work <br />of the Contractor or the Section 2. Additional Work of the Contractor. <br />SECTION 5. TIME SCHEDULE <br />5.1 Unless otherwise directed by the CITY, the CONTRACTOR shall <br />commence the performance of the Section l. Basic Work of the Contractor upon <br />execution of this Agreement and upon receiving approval of CITY's Construction <br />Manager. <br />5.2 The CONTRACTOR recognizes that time is of the essence in the <br />performance of the services required under this Agreement and that services are to be <br />performed as expeditiously as practical. The CONTRACTOR therefor acknowledges and <br />agrees that it shall make every effort to substantially complete the Section 1. Basic Work <br />3 <br />
