(b) hours of vacation which the employee did not work but for which he <br />received pay pursuant to Article 21 of this Agreement; <br />(c) Hours of jury duty or witness duty which the employee did not work for <br />which he received pay pursuant to Article 26 of this Agreement. <br />There shali be no pyramiding of overtime. <br />Section 7. if a time clock is to be used for a department, all hourly employees <br />shall be required to clock in and clock out at the beginning and end of each shift. Any <br />employee clocking in late will be docked to the nearest tenth of an hour. Any employee <br />working overtime the approval of supervision shall be paid overtime to the next tenth of <br />an hour. <br />ARTICLE 11 - DISTRIBUTION OF OVERTIME <br />Section 1. The City shall be the sole judge of the necessity of overtime. All <br />overtime shall be voluntary and an employee shall have the right to refuse any overtime <br />assignment except for emergencies. An "emergency" is defined as any impairment to <br />City services or operations which cannot be delayeci until the beginning of the next <br />regular work day. In non-emergency situations, the City may require the least senior <br />qualified employees in the classification who are available, to perform the overtime work. <br />Section 2. The City shall endeavor, insofar as it may be practicable, to make a <br />generally equitable distribution of overtime worF; among employees within a <br />classification and department who are capable of performing the available work <br />satisfactorily. Employees who are offered overtime and for any reason refuse or fail to <br />work, shall be credited with the overtime as if they had worked, for the purpose of <br />overtime distribution. An employee who works overl.ime will be credited only with the <br />number of hours he actually worked. An employee who should have been called for <br />ove?time. but was m+ssed, shall have deducted from his equalization total the number of <br />15 <br />
